hello
last week i purchased a tv from a web site at a bargain price my payment was accepted and an email recieved stating;
'We are pleased to confirm that your order has been validated and we are currently in the process of preparing it in our warehouse'.
My payment was processed onto my credit card then today i have recieved an email stating;
'Unfortunetly your order has been cancelled due to technical difficulties with our website at the time you placed the order'.

'We can confirm that this has now been cancelled on your account and you will be refunded back to your card within 3-5 days'

can they legally do this ? i have phoned them and they state it is within their rights to do this but they would!
any legal eagles out there can give me any advice ?

theres nothing you can do whatsoever best you could maybe get is 10% or something as goodwill gesture

They can do it, unfortunately. It's a shame, can you try to negotiate a better deal on it?

Same with anything, they make an invitation to treat, you make they offer, they decide to accept or reject. An automated email has been ruled not to be acceptance.

Indeed but when does the acceptance occur. I used to think it was when they took the money but that doesn't seem so clear cut these days as having work on developing Epos systems in the past they all work on the basis of asking for the money from card acquirer, getting the auth code (which effectively reserves the money so appears to have been taken if you have access to your current balance) and only when the shop in turn send the settlement (for all the payments that day typically overnight) which includes this auth code its only then they have technically taken the money. If this is the case then I would guess that etailers may only carry out settlement when they ship the goods and so they haven't accepted until then?

this does seem to be the case ! thanks for your info will just put it down to another of lifes little lets downs lol!
