pay pal dispute over buyer protection

has anyone ever had to use buyer protection on paypal?

recenttly I just bought an ipod touch and the seller never sent it, then her feedback went onto private and her e-mails started bouncing so when I pulled her phonenumber off ebay and it dint worked I started a claim on paypal but its taking a golden age!, do you think ill get my money back?

yeah you should get it back, but it will take a few weeks for paypal to investiogate, but you should have no problems getting it back

isn't that as long as they have the funds in their paypal account though?

Ive put a claim in before and got the full amount back, I'm just in the middle of my second claim now and i think it takes about 10days.

Update! I just checked and the seller i disputed has refunded me :)
all is well. I hope you manage to get things sorted too.

thanks all off you, I'll keep you all posted, I think I'm just gonna buy one brand new or on here If any pop up soon as this is my second time having trouble on ebay to bella

Not for an ebay auction purchase that meets the conditions for buyer protection.

theres no 100% guarantee you will get your money back even tho its covered under protection, thats paypal for you, you may only get back whats in the sellers paypal account if hes withdrew all of it, then you will prob end up with nothing

Have you raised a claim with paypal or just filed a dispute? If you have escaled the dispute to a claim then the seller has 10 days to respond before paypal finds in your favour.

You mention 'its taking a golden age!'.

How long has it been since you escalated the dispute?

its only been 2 days since I escalated the claim, but it took 2-3 days before I could escalate it, it should be fairly obvious to paypal who is in the wrong.

"Item took about 2 weeks to arrive"............ so no one actually never got the item.

Dont know why you are worrying then as it hasnt been 2 weeks since the auction ended. You will be covered by paypal too but they won't award refund until 7 more days without a seller response. You may end up with the phone and a refund ;)

ahhh nice one :) that would be nice, its an ipod touch btw... but If I did recieve it I would probably refund her as I dont want any trouble of anyone. :) thanks for your help all off you.

so nice one paypal "buyer protection" really works.

That is a joke. Surely they are committing an offence to advertise buyer protection and then not pay out.

I trust the seller has at least been banned from ebay!

If you paid via paypal with funds from your credit card then you can still do a charegeback to recover your funds (paypal dont advertise this right too publicly!).

Card Transactions. The Buyer Protection Policy does not replace or reduce any other consumer rights you may have, including reversal/chargeback rights that may be granted by your card issuer. Card reversals/chargebacks, if they apply, can be filed more than 45 days after the payment transaction, are not limited to funds credited in a seller’s account balance at any time and cover cases where the goods are not as described by the seller as well as cases of non-delivery. You acknowledge that we do not control the outcome of any reversal decision initiated through a buyer’s card issuer.You can choose to pursue the PayPal complaint procedure (whether filing a dispute under the Online Dispute Resolution procedure and/or filing a claim under PayPal’s buyer protection policies) OR your card reversal/chargeback rights; however, you are prohibited to pursue both at the same time or seek double recovery. Did you actually claim under buyer protection rather than just a paypal dispute?
If so you need to appeal, and ring them and you should get your money back.
Check the ebay forums, there are some threads about this happenings.

Hi Guys first up thanks for your help its much appreciated.....

I actually started the dispute via paypal.com and not through eBay, I'll go and try through eBay just now, and I am going to write out a chargeback letter to my credit card company just now and try and get them to chargeback the fund from paypal.

the ebayer must have moved country or at least house. :(
