I was sent a faulty item (Ebay)so i raised a pay pal claim, this is the response;

We have determined that you may be eligible for a refund on this PayPaltransaction. To qualify for a refund, please return the item received tothe seller in the same condition in which it was received. (You areresponsible for postage and packing costs for the returned merchandise.)The amount you will be eligible to receive is determined by the terms ofour buyer protection policies, and we may be unable to make a full recoveryof your payment from the seller. Please review the buyer protectionpolicies in our User Agreement before returning the item to the seller.

So i paid postage for the item to be sent and i have to pay to send it back and by the sounds of it i amnot guaranteed to get money back!?!
HELP?

How much was the item. Did the seller have the standard eBay £150 protection or the £500 verified protection. As long as it was under the relevant amount then you will get a refund :thumbsup:

I agree. :thumbsup:

This is all wrong and I don't agree with it, :x but that's Paypal and ebay I'm afraid. :x To be honest you need to work out the cost and hassle of returning the item, to see if it's going to be worth it.
What are the Coms like with the seller?
If you do return it don't forget that you MUST use a trackable signed for service.

The item was only 30 and the seller had insurance but for some reason started to ignore emails, then when i raised a claim with pay pal stated that nowhere in the listing did they ever state thst the item was working. It just became a matter of principle. I just don't see why i have to pay to return a faulty item when pay pal can't give me a def yes or no for a refund so potentially i could loose more money (ret postage)

If you look at the eBay listing you purchased. On the right hand side under their user details it will say whether they cover for £150 or £500 on PAYPAL transactions. :)

They have to state in the listing whether the item is faulty.........otherwise all goods are presumed to be in a fair and working condition. Also report them to eBay for listing policy breaches. :thumbsup:

Just looking at Pay pal and found this;

Actions taken on the disputed funds. If a buyer files a dispute against you, PayPal will place an amount equal to the disputed amount on hold until the dispute is closed, or if a claim is filed an amount equal to the amount claimed will be placed on hold, until the claim has been decided. PayPal will also hold an amount equal to the disputed amount if a chargeback has been filed against you. If a dispute is escalated into a claim which is awarded against you (as a seller) or a chargeback has been filed and upheld against you, you acknowledge and agree that:

you owe the disputed amount to PayPal;

you agree that PayPal may set-off the disputed amount from your account(s) or you will re-imburse and pay PayPal the amount you owe by other legal means; and/or

you account access may be limited and your account balance may reflect an amount owing to PayPal.

It states that if the seller has no money in the account i will not get my refund but reading the above makes it sound like Pay pal should have held the money and can therefore guarantee a refund before i post the item back?!?

Paypal now guarantee a minimum of £150 cover on all eBay purchases made through them anyway. One and the same company. :)

As long as you return the item by a trackable service (Recorded or Special Delivery) then you're fine.
