A while ago I bought something from eBay, paid via paypal. However the seller sent over an empty box. Today the claim I filed turned to my favor, and said:

We have concluded our investigation into your case and have decided in your
favour. You have indicated that a partial refund of xxxx GBP would be
satisfactory. If the seller's account has insufficient funds to complete the refund owed
to you, please be assured that we will take appropriate action against the
seller's account, which may include limitation of the seller's account

What to Do Next
No further action is required by you at this time.

So far I've not received any refund - I guess seller cleared out his fund. But since I'm covered by buyers protection, and paid via paypal, should paypal cover my loss?

Partial refund I asked for = cost of item + P&P. Its exactly same as I'd have got otherwise.

How long does this refund take?
Yes you would be covered under BP if you paid via the auction so you should get the full amount, WHY did you anly ask for a partial refund though?

check out new rules for buyer protection on ebay,
from now on they will either automatically take it from seller
or if they don't have funds ebay will pay it and chase the seller for it.
