paypal/ebay help pleasee

hi, i sold a faulty psp on ebay, the buyer emailed me an offer and i acceppted it, hes now opened a dispute on me that it wasnt as it was described, i specifically wrote that it is faulty and is sold as is with no returns, we done the deal out of ebay i would say, is there anything i can do?

Sounds to me like you listed an item on Ebay and then done a deal privately to avoid paying Ebay charges - fingers crossed you have to pay the buyer back and lose out on postage costs too !

well the item was on auction, he gave me a price i was happy withand ended the auction early, and paid me in my paypal. I delivered it to his house as he doesnt live very far

Hi mate, what do you mean you done the deal out of ebay. Has he opened up a dispute with you via paypal or ebay.
I'm guessing you listed it on ebay, He made you an offer via ebay and you sent him out a paypal invoice.
Let me know if this is how it happened, If not, let me know exactley what happened and i will advise on what to say and how to deal with this buyer.

well i listed the auction, he offered me a price i was happy with, i ended auction, i didnt send him an invoice, i gave him my paypal address and he paid the amount, then i dropped it off at his house
he opened a dispute for the reason being "not as described"

edit: i sold it for 45, i wanted 55, but he told me he would give me 45 as there might be other problems, i messaged him saying that there may be other problems therefore no returns, so he bought it off me for 45 as there could have been other problems

Unfortunately it seems he doesn't have a leg to stand on but if he has your personal details he could make life difficult for you!

yeah, thats what i thought, will paypal take the money out of my account to refund him, and is there a possibility that i'll have to refund

now if hes sent a dispute saying its faulty hes trying to con you and get the money back and keep the console so you have to

1) tell paypal or who ever that you did not send the item as you closed the auction (this is backed up by your ebay page)

2) insist that the money payed in the account was for a fauly console thus stated in the advert and if further harrasment follows you will file a complaint thru ebay and the police

3)close your existing account and open a new paypal with a new e-mail (just so your dont loose any money ;))

if all else fail post an ad on ebay claiming he is a scammer and post his address too name and shame the foool

Don't Refund him, stick to the fact that you have described the item as accurate in your listing as i had a messed up listing in the past and paypal granted the person their refund as although i sold a brand new phone my item description was for an old phone that i sold ages before i sold that phone and the buyer had scammed me.

however there are current regulations which means a buyer can't easlily get off the hook, as for someone i seen mentioning you should ask for cash "ebay strictly prohibbits any listing for asking for COD or cash by mail as the many disputes that happen over them the odd listing slips through the system but others get removed.

Unfortunly this comment is untrue ive been running my ebay account mega-celler for more than 3 years now i have been even a powerseller in the past and have made over 2000 sales on ebay god knows how many people have my details plus the fact i have all their details, in any case if someone starts threatening me i call the cops as their is laws in place, if someone starts harrasing me i call the cops and give ebay the case number and they ban the person from ebay for harrasment after they've checked it out.

and if you don't want to go down that route they have your details, well infact you have their details too so anything they can do you can do better if they for instance in the past order a bouncy castle to your door at £50 a day you can order a skip for 14 days to their door at £30 a day for 14 days and see how long that carry on lasts.

Just noticed this page mate;

Number 2 all good

Number 3 you cant do as you can't close an account with an active dispute, even by changing your bank account and email address you will still be charged.

And for the point of posting his name and address and name and shame him is actually illegal under the Data protection act, as you can not do that you can actually be sued for stuff such as slander. not advisable

Interesting case, I'm not sure how Paypal are going to treat this - if the deal had gone through ebay then I think you would have been ok as you've clearly described the item as faulty. However I don't know how Paypal verify 'not as described' issues when the deal is done outside of ebay.

I don't know if I am totally correct but it looks like this bloke who bought the psp off you went against ebay rules...you are not allowed to ask for a buy it now or to end the auction if you don't have a buy it now price etc so to start with he has gone against ebay rules. With Paypal I don't think that anything could be done as you sold it as faulty and he knew this beforehand. Have a look at the ebay rules but I'm sure that this is what they state?

Before PP issue a refund, the buyer must provide proof of sending the item back to the seller. He will have to use a postal service with on-line tracking.
No on-line tracking number = no refund.
