Paypal/Ebay issue UPDATE advice needed please

Hi all, again :O) Sorry long post!

Some time ago I started a thread asking for a cheap DS as I had been scammed on Ebay. You can find it if you look for other threads started by me.
I have some updates and need your advice please.

HISTORY

1- Bought DS on Ebay
2- Paid for it through Paypal
3- Ebay sent me e-mail saying not to bid/pay as the seller was fraudulent and their account has been closed _ by that time I had already paid as auction had already ended!!!!
4- Seller would not reply my e-mails
5- Put a dispute through Paypal
6- Paypal ruled in my favour but told me that there werent enough money in the seller account to refund me
7- Paypal closed dispute automatically


UPDATE


1- After Paypal outcome I contacted seller again for last time to tell her how upset I was
2- Contacted my bank to dispute fraudulent transaction- they sent me forms to fill
3- Seller finally replied that she had not got the money however after an exchange of several e-mails she agreed to send me the DS and apologised
4- DS received sent via Recorded Delivery
5- I suspect strongly that the DS is fake. It is yellow (Pokemon special edition), as I bid for it, but that didnt worry me because import DS come in different colours BUT the plastic is so thin that you can see the round speakers through the top flip part. It is all very flimsy, light and the built quality is just not there.
6- I compared my other son original one with this one and the writing at the back is exactly the same apart from the serial number it starts with UG but the letters and numbers are a different font. There are 8 numbers and the last number has a little square around it. The original DS has all the number close together the fake one has the last number a bit off the right.


What do I do now?
If I send it back I wont get a refund because the seller account is blocked and she wont refund.
Cant return the bank forms because now I received the item.
All your opinions, suggestions, and advice is welcome.

Did you not get any refund from paypal? I thought now that even if the seller didn't have any funds you got a maximum of £150.

looks like your kinda stuck!

is it possible its a real ds but with a new casing put on? coulda been broke or somethin n they did quick repair n sold on.

Failing that if the ds does actuaally work could consider changing the casing yourself to something a bit more sturdy?

It sounds like you should cut your losses in order to save yourself more upset, however...I didn't know Paypal would refuse to honour a fraudulent transaction if the seller didn't have funds in their account. In my mind Paypal have something to answer here

Id agree, it might just be cheaper casing, .. dont know how cheap it is to buy, but hear it simple to do yourself. Im hoping that whats said above, is the case.

As i dont know anything about paypal etc, all i can say is good luck!

That's what I thoguht too? What happened to payment protection???

They are just washing their hands of it! WIll not use Paypal again! :x

The case was supposed to be yellow because they supplied it boxed it and both the box and istructions are with the yellow colour on in and the pokemong pic.
However it was not complete. It has the stylos missing too.

Is not a question of changing the casing because my son likes it yellow but the buttons cant be changed and they do feel different.
And anyway how would a new casing have all the serial number on it and so on....:thinking:

ive seen the pokemon ones, but maybe they are all like that.. suppose its all what if's tho.

clearly just a dodgy seller, (like you didnt know) .. im suprised paypal cut you off quite quick tho, with the end result... mind you my OH has had many a problems with ebay and paypal. im starting to think they arnt remotely bothered.

I do hope something happens in your favour.

no it doesnt really matter but the point is that I didnt buy it as a replica, it was supposed to be original and If I have to spend more money on top then I am not really sure it's wise considering the loss already

Paypal took a decision in a couple of weeks if I remember well _ after waiting so long to file a dispute in first place.

Of course you should get what you paid for... but i havent considered it a loss already, hense im wishing you good luck.. i think you just have to constantly be on to people nowadays.

yes, i cant remember the details of what happened to the OH, but he had to push it.. its silly really.

The buttons can be changed and are supllied if you buy a new case, we have recently got one from Deal Extreme to fix my sons DS it was cheap to buy but the case is good quality and they have loads of colous that you cant buy a DS in!! :thumbsup:

I still dont get ou but never mind...
it was not obvious to me when I paid that it was a fraudolent transaction, but anyway moving on...

my post was not about the case (obviously I described it as why it does not seem genuine to me) it was about dealing with receipt of a non genuine article, the thread is going off the rail a bit

thanks for letting me know about dealextreme something to think about there but the case is not damaged so wont be changing it for the tme being there is no point changing a fake case for another fake case,even if it's more sturdy it still defeats the objective and doesnt resolve the original issue that the DS is not original...

Seems the concensus is to just accept the "loss"...

I guess you could contact Trading Standards but then I would also guess that you run the risk of it being confiscated if it is a fake and if the seller still has no funds you could be in an even worse position. Small claims court if you really want to push it that far? but that may still mean you get nothing especially if they are officially insolvent or bankrupt. BDY ebay winds me up with all the scam merchants (and buyers) on there at the mo - it seems to be getting really bad lately

You'd be lucky to get anything out of paypal. If you ask me, Paypal are just a big scam too!
I got scammed last week for someone alledgedly selling ps3 games. I paid for game via paypal, then about half hour later they were then banned!

never heard a squeek from then since so opened dispute in paypal. they never responded to the dispute AND paypal went in THEIR favour!!!! Figure that one out
