Hi all, thought i'd vent my anger at Paypal and hopefully get some advice!

I recieved a 20% voucher from ebay/paypal for being a valued customer, i was obviously happy with this and thought i would put it to good use and buy something or my upcoming wedding. I used buy it now on the ebay auction and it ended up as follows

1. Total - 220
2. 20% off - 44
3. I paid 176

The auction had splattered across it.... this auction is covered by buyer protection for the full amount (or I wouldnt have touched it!)

After nothing was recieved in the post and little help form the seller I escalated it to a claim with Paypal. They after 8 weeks closed it in my favor... fab!

Now they saying I was only entitled to what they can take form the sellers account....

25p!!!!!!!!

to make it worse they are saying because I used a voucher they gave me they want ME to pay them back the difference! So to sum it up they are asking ME to pay them £39.75 and I have lost £176!!!

Surely this cannot be right??? I would never have bought this item if I hadn't thought I was covered. I can't see what I'm doing wrong in the Ts & Cs, item was bought on ebay.co.uk, shipped from and to the UK.

if you payed by credit card even though you payed through paypal call your credit card company and file a dispute with that payment and they will look into it for you, your cedit card company don't like doing this, but I quote them the credit card act 1974 and I got all my money back

Might be worth seeing if your bank would reverse the transaction? Probably not, but worth a phone call.
Yogi - congrats on getting that to work. Under Consumer Credit Act (not Credit card!) the processor is jointly and severably liable, but for the purposes of paypal (and their lovely user agreement) the payment was to paypal for processing the payment, which they did, and you actually have absolutely no legal right to a refund. Much better to avoid paypal completely.

Give them a call and explain the situation. They are in America so think differently lol... But write the sums on paper and explain it to them... hopefully if they can count it will all add up. If not then speak to their manager and see if they can help..

If all fails take it to trading standards! I dont see you being in the wrong and should cover you for every penny you paid.

Best of luck and let us all know how you get on.

How do you know they are in the USA? trading standards wont be interested.

How do you know they are in the USA? trading standards wont be interested.

Sorry I meant that their call center people are in US. everytime I ring them or they ring me it an american accent!

back again, wow thanks for all the replies, i have emailed them and will call when i leave work

I spoke to someone who must have been in an american office, they had a very mexican accent and we weren't seeing eye to eye on any of it

the basis of my email was this.... (which a bit of googling helped to find)

my item was covered under the Paypal BUYER PROTECTION claim scheme which the Ts & Cs state i should get a FULL refund regardless, it seems they are trying to fob it off as a BUYER COMPLAINT claim which the Ts & Cs state they can only claim what is in the paypal users account

it is utterly disgusting tho! and i'm willing to be they won't pay up without a fight!!!

they have a few call centres i always get through to the irish office in dublin i think but i dont use the 0870 number i get another from say no to 0870 which is an irish number

no it was all done by the rule book in Paypal and on Ebay

cannot see how ebay / paypal can get out of this one. Listing clearly states paypal protection. Did seller not have to provide evidence of posting and receipt your end?

I looked at the item and then clicked on the FREE PROTECTION link on the items ebay page. The following was in the T&C's (not sure what the difference is between buyer complaint & protection, same thing I thought):-

Buyer protection is the one where you are guaranteed your money back if you follow the proceedure, complaints is the one where you only get back whats in the paypal account.

13.1 How am I protected if I have a problem with a purchase?

PayPal has 2 programs to help protect you:

1.

PayPal Buyer Protection (for eligible items purchased with PayPal on eBay)
2.

PayPal Buyer Complaint Policy (for all other items purchased using PayPal on or off eBay).

13.7 How much coverage do I get with PayPal Buyer Protection?

If you see the eBay.co.uk buyer protection message and if PayPal determines a Claim in your favour, PayPal will reimburse you the full purchase price of the item and original shipping costs only. For listings in countries outside of the UK, PayPal will re-imburse you for the full purchase price of the item and the original shipping costs, up to the coveraged cap specified in the applicable buyer protection message (provided that you are eligible for payment). It is similar to PayPal Buyer Protection in that it enables buyers to file a Dispute for an Item Not Received (INR) or for an item Significantly Not as Described (SNAD). However, recovery of any amounts is not guaranteed and is limited to the amounts that PayPal can recover from the seller’s Account, even if it finds in your favour.

Paypal are not a bank - just a processing facility company, thus the lack of regulation.
Google paypal sucks - massive website full of complaints.
