I realise that Play doesn’t need to add VAT to items costing below the VAT threshold which is roughly £18. But I figured that items costing more than that would have VAT added so that it should be possible to get a VAT receipt!
I bought some memory from them for £50 and they are saying:

“With regard to your query, please be advised that these items are VAT exempted.”

Is that correct? I need to speak with the VAT office tomorrow anyway but I figured that you clued up HUKD people will probably know the score.

does it make any difference that its a Jersey company ?

i know if you live on Jersey and buy from them you have to have the stuff sent to you via the UK to enable the prices to work for you.

If I was charged vat for items under £18 can I claim?

Not entirely sure but tax is at the local rate 3% GST and as no uk VAT is paid none can be claimed. But as I say just a guess.

“VAT is a tax normally charged on the supply of goods (and services) made by a VAT registered business in the UK. For goods brought in or sent to the UK from the EU there's no extra VAT to pay unless you're ordering or sending purchased goods from one of the EU Special Territories, such as Jersey or Guernsey, in which case you'll have to pay Import VAT.”

Import VAT allowances
If you're posting goods to the UK, or ordering them from a non-EU country, you, or the importer only have to pay Import VAT above a certain value.

After reading up some more it seems that Play do pay VAT on goods over £18 but as they are not UK vat registered you can't ask for a vat receipt. Not that you need one as you agree to their T&C's and T&C number 2 states "Your contract for purchases made through the Site is with Play.com, and you undertake that any and all goods ordered by you are for your own private and domestic use only."

I spoke with the VAT office and they say UK import VAT will have been paid and it can be reclaimed using form C79.
I’ll need to chase that up and good to know for future reference.

So basically HMRC will supply the VAT info so no need for a VAT receipt? Is that how I'm reading it?

I just phoned Play and without any hassle they just said they’d post me a Vat invoice within 7 working days.
Another example of how it’s always worth contacting a company again if you aren’t happy with their first response.
The irony is that I noticed this week that the Despatch Note says:

“This is not a VAT invoice.
A VAT invoice will follow in a few days”

After speaking with the VAT people it seems as if they are obliged to provide the information required so that a business can reclaim the VAT.
