Oh the irony, bought a new phone on Ebay last month with last of my funds since my old phone broke and it never arrived, seller was a powerseller but had a rep of items taking 3-4 weeks to arrive(UK based) waited until Tuesday and opened a dispute, heard nothing back but yesterday got a card from RM saying a RD packet had arrived.

Picked it up today and its just a big envelope stuffed with blank dvd cases and I know its from seller as the name for return is the name I got on the dispatch email originally

Since I opened a non recieved dispite what can I do?

you didn't recieve what you ordered-so you still haven't recieved your item, therefore i'd say dispute still stands.....and do it fast-not sure what the time scales are-but there are cut off points for claiming aren't there............did you pay with paypal-they might be able to help?

What a rogue! Go and add the extra detail to the PayPal dispute.

Im guessing that you cant change the claim from 'not recieved' to item is not what i ordered!?. Can you do it through ebay and tell them that you have received it but it isnt what you orderd!

So did he send that dodgy package to show he sent you the phone by showing a tracking number with your address?

It isn't usually possible to open a significantly not as described after you have opened an item not received. However, I have heard of paypal allowing it under certain circumstances, you will have to contact them first. I have phoned them before now on this number, but it was a while ago: 08003587929. Good luck.

sounds like he's done that to say you've received the item etc and then your word against his about the contents. by the time it is settled he's off with your money! shame paypal can't debit cards registered on the account although i guess they'd contact their bank and get it reversed.

take a photo too of the cases in the envelope.

take photo's of the package, the royal mail slip with the weight etc

ring paypal (# above or use [url]www.saynoto0870.com[/url]) & ask them to change dispute from item not recieved to Significantly Not As Described (SNAD)

paypal should do this without too much hassle

when paypal have changed the dispute & u (hopefully) get your money back

leave them a HUGE neg & file a ebay seller dispute ....... get the person kicked off

Recorded delivery is not good enough for a seller to use as evidence that an item has been received. No tracking no. on it. Has to be a minimum of special delivery with royal mail.

not true ........... royal mail recorded delivery is accepted by paypal

but

RD is so bad for tracking, half the time, the postie doesnt get it signed & its not put on the system...... special delivery or courier is the best option but RD is accepted

plus RD is only worth upto 10 x a stamp which is £36......... the seller would have lost out if you didnt receieve the item as he would only get £36 back from RM,..... only special delivery should be used for phones

I suspect this is what has happened. Seller sent the actual phone via recorded delivery and it got lost and seller realised he could only recover £36 from RM .

So once ryouga raised a dispute, he sent the empty cases via recorded delivery so he had tracking info for paypal.

could be .......... or he just sent the cases to fool ryouga ........... a lot of people won't know that this is a scam & paypal can side with them .........

I think you will find that you cannot track a Recorded Delivery Package, only determine if it was delivered or not.

Just checked my account and hes added the tracking details to the dispute.

Bit of a coincidence isnt it now its been signed for but didnt add them before.

he is trying to screw you ....... ring paypal & get them to change your dispute NOW.....

they are likely to close the current dispute asap ..... so ring them NOW

in my book, proof of delivery & posting = tracking :-D

Think you will find this is fraud, contact the police immediately, this guys finger prints will be on the cd/dvd cases!!
Let's see him explain that one!

This may well be a criminal offence of deception. If you have no luck with paypal, you should contact your local police. He is easy to trace and therefore arrest. Each one I've done has gotten hammered in court and all the money back for the IP (injured party,you)
"Dishonestly obtains property belong to another with the intention of permanently depriving the other of it" is the definition - off the top of my head though........
He has satisfied all of the points to prove within this definition already and therefore you will not lose the criminal case. There is no time limit on making the complaint, so I would try paypal first then let him know you are going to the police unless he sorts it.

I could prove that the baby things were never in the envelope by the amount of postage paid but paypal would have none of it and as the seller had given the tracking number to them i was boogered.

Revenge is sweet,hubby was fuming,he waited a while went and set up another ebay id,bid on one of her items and then messaged her asking if he could pay by cash,he then got some doggy doo doo and popped it inside a jiffy bag with some loose coppers for a good money sound effect and posted it off to the seller recorded delivery,then he sat at the pc refreshing royalmails tracking page until she signed for it lololol

csi is right, you get proof of delivery, not tracking as such but in this case that is what is required.

Good advice about getting the police involved.

You're getting the word tracking confused. In this case tracking is not required. Mearly proof of delivery.

Tracking allows you to see where it is/ where it was lost.

If it was an expensive phone, i personally would drive to where they live.
If it was 10-20 quid id be annoyed but if it was 150+ plus i would go mental.
The fact they have sent you blank cases just to prove they have sent you something is damn wrong!
