My problem is this, I ordered X2 sun lounger covers on 30th nov through "buy it now" and paid £9 for delivery total order was £29.96

I had an email from this company on the 3rd Dec stating that the items were being shipped, in their notes they said it should be received within 24hrs but they could not be held responsible for any delays. Not being in any particular hurry for the items I was'nt that bothered how long they took as long as they got here.

I did wait 6 days allowing for the fact that it was xmas and deliveries might be slow, when I received nothing I emailed the company who told me that they had checked with DHL and they had attempted to deliver and left a card, as I had'nt responded the items were sent back to the supplier.

I can catagorically state that I have received NO card through the door at all! and emailed the company back to inform them of that (why on earth would I not respond when I have paid for these goods and am waiting for them to be delivered). They just went on to say tough luck really, DHL would have emailed me also to let me know (again no email received) and in their terms and conditions I should have informed them within 2 days if I had not received the goods.

If I still want to keep them I will have to pay another £9 to resend or cancel the order forfeiting the original delivery charge!

I have phoned DHL who were very polite they could not understand what had happened but they said no problem the supplier will have to ask for a FREE delivery through their local DHL distribution centre (this came from the manager of my local distribution centre responsible for deliveries in my area).

I emailed the company and informed them of what I had been told, to which they said they had been told the total opposite when they contacted DHL. They now want my phone number, which I am not too happy about giving out to discuss further. To be honest I don't want to talk to these people over the phone as I don't really want to get into a slanging match with them nor do I want to pay another £9 for delivery when I have'nt as far as I can see done anything wrong!

I have reluctantly given them my phone number today as it has been a week since the last email and I have heard nothing. Does anybody know what my rights are in a situation like this, it seems to be their word against mine and I don't seem to have any defense, its all making me quite mad!

Did you ever get a tracking number to check that they were actually sent & the seller's not just making up a load of rubbish?

I've had a similar problem recently but as I paid with paypal I simply opened a dispute for non delivery of the item and got a refund through Paypal. Even if you paid by cheque or some other method it is worth opening a dispute through ebay so that you have a recrded record of what has happened so far.

If you paid with Paypal put in an INR claim NOW. You will win as they have to show tracking info that the item has been delivered and signed for. Been there, done that. ;-)

Oh and when its finished with leave them the ****est f/b you can think of.

report them on ebay for item not received - you still should be within the time limit

When I emailed them to say I had not received the goods they did give me a tracking number which I used to query the delivery with DHL, but by that time they said the goods had been returned to the supplier. The company do not deny that they have received the goods back, just that they want me to pay £9 again to redeliver or cancel forfeiting the original delivery charge.

Speak with ebay customer services, their number should be on the main page. They can make some enquires for you

put that tracking number into DHL and see what it says, should show that u didnt recieve goods so therefore supporting your argument

We've been saying that for years. No number for Ebay exists, unless you're a powerseller and have an account manager.

Was that a recorded message? Didn't it give you the opportunity to speak to anybody?

Do what I said, if you paid with paypal (and about 95%+ do) claim INR and they will HAVE to refund the FULL amount. Then buy from a better seller.

Yes the message was recorded, but I could have stayed on the line to speak to an operator but did'nt really like to as I "had'nt been invited" so to speak :whistling:

I think I will probably have to resort to opening a dispute although I don't want to make the situation any worse than it already is. However, Christmas is now upon us and I don't see any sort of resolution any time soon due to holidays etc. and I believe there is a time limit to submitting these things both with Ebay & Pay Pal, do I need to open dispute with both of them or just Pay Pal?

Go directly to Paypal as I believe they sort all ebay disputes now, well the PP funded ones anyway. You won't be making it any worse than it is, that's just guilt pangs. The seller and DHL are the ones in the wrong, not you. The seller should have sorted it with DHL, not started demanding extra payments for a service you hadn't received but had paid for.

If you dont get your goods, you are entitled to a full refund from PP (assuming you used PP).

Please do as advised. You paid for the goods and you haven't got them. I'm sure you will have paid through PayPal so do it now...it doesn't take long. And I wouldn't want to give my number out either but you don't have to. Good luck :thumbsup:

Yes I did pay through Pay Pal, and I have requested the retailers info and will give them a call in the morning they are still submitting peoples feedback right up until 22:28 so someone is still working, yet I have not received any reply to my emails.

If I don't get any joy with them tomorrow I will open a dispute with Pay Pal and keep my fingers crossed. I find it really appalling that consumers can be taken for a ride this way, it really does seem to be their word against yours situation, I guess that is the risk you take when ordering on the internet or should I say E-Bay ! :x

I don't disagree with what you have just said, but at the end of the day where does that leave me the customer? I ordered and paid for items in good faith and have not received them or any notification be it card or email regarding delivery of them from DHL. I do think it is DHL that is at fault, but is it my responsibility then to sort out the mess? As stated I have spoken to DHL and been advised by the manager of the delivery depot how the situation should be resolved, but still nothing seems to have been done.

Should it be me then that has to pay for the couriers incompetence or should the matter be sorted out by the supplier of the goods who has a contract with DHL?

We where supposedly left a card by DHL once, played merry hell with them as we hadnt received a card, turned out as we later found from a new neighbour the card had gone through her letterbox, they hadnt put an address on only name and consignment number so she assumed it was for previous tenant! How they could misread 28 for 34 I dont know,
It makes this a difficult scenario because it looks like the courier is to blame, but once the goods are in the couriers possession they are working on the behalf and are hired by the seller, it may be your money they are using to pay the courier but until the goods are in your hands it is down to the seller to make sure you receive them, I personally would open a paypal dispute andlet the seller sort the problem out with the courier explain that you never got a card in your dispute if need be. I wouldnt do as someone else has said though and leave negative feedback as you may get one yourself in retaliation as I have seen on other peoples accounts when checking them out feedback wise, if someone has a negative I always double check the person who has left the neg and get my own opinion to that, although if you are only a buyer and have no intention of selling and have a fair amount of feedback then a negative wont harm you. Negative feedback will harm a seller more than a buyer! What other feedback do they have? If possible can you pm me either the item number or sellers id and i'll look into them for you maybe I can help more with info from that!

They do have a few negs, but they sell so much it does'nt really have much of an impact on them I think. For a company who sells so much It amazes me that they would try to pass the buck in this way. Even though I told them I had'nt received the card their reply was tough luck terms and conditions state I should have contacted them within 2 days of dispatch to say I had'nt received them. I feel like a gullible fool now for allowing them so much time to deliver, I just thought that with the xmas period things are delayed (obviously I should'nt have waited so long)!

Also when they received the goods back from DHL why did'nt they contact me ! It just seems like a tit for tat situation really, and I am probably going to have to pay for it if I want my goods, either way I think I will end up paying £9 more for the items than I wanted to or canceling the order and accepting the fact that I have lost £9.:-(

They do seem to have a lot of complaints about their delivery service. Neutrals in general tend to tell a broader story than the negs.

Checked with the neighbours whilst delivering my christmas cards just in case it had gone in the wrong door, either side have not received a DHL card, neighbours 2 doors down are away at the moment since 10th Dec could have gone there I suppose, but I am inclined to believe they did'nt bother.:x
