Professor Layton DS game - unopened but Argos won't give my money back - what should I do?

I bought 2 copies of the Professor Layton game from Argos as a gift for my nephews for Xmas. I then found out that 1 has the game and the other is getting it from his dad. So I thought I'd get my money back only to be told by the Argos Manager that the game is "Exempt from the 30 day Guarantee" ie I couldn't bring it back, but as a "goodwill gesture" he would exchange them for Argos vouchers.
I told him I didn't particularly want anything in Argos, and the credit back onto my credit card would be better for me. Anyway, he wouldn't give in, so I told him I'd have to think about it.
Anyone got any ideas how to get around this situation - I can't really be bothered with selling on argos vouchers to be honest.

There is nothing you can do, besides begging. I'd sell it on eBay. I did with an opened one and got £41.00 for it. Still not sure why I got that much though. :)

There is nothing you can do except maybe get the vouchers and give them as a gift, or sell it privately.

Do Argos Stores vary on whether they refund by credit card or vouchers, or is it a standard line with this exemption thing? If I went to another store might I find a manager who sees this differently?

Their policy on games / consoles and other things is they will not accept them back regardless of condition unless they're faulty. It'll also say that on your receipt. You can't do nothing except ebay, trade in, or vouchers.

Get a cheap pack of electronic lighters from market or poundland and take one apart to get electronic clicker and then take ds cart and start clicking on the gold contact grooves or strip a ghetto blaster lead and give it 240 volts then take it back to Argos as faulty or damage it somehow and take it back and get refund if they say oh we will have to exchange it for another say no thanks but you can replace the Nintendo ds the dodgy cartridge you sold me broke. So I have no use for ds game without a ds now.

Thats why your asking what to do instead of standing in Argos until the a hole that said even though it's still sealed they will not give you money back and why I am banned from my local Argos LOL

Seriously you are too nice, get tough and stand upto this nonsense I doubt there is a law on the side of Argos(who make em up as they go) and especially as they cannot prove the teller told you about 30 day nonsense (I always shut my ears by humming a tune when they speak to me that way I can honestly say I never heard her/him spout that drivel) I am not joking about that I do do it.

Still sealed this game though which makes it even worse and a lack of common sense on Argos manager part I would also stop shopping there and tell head office this actually ring head office and tell them you are getting your whole family to stop shopping there so next Xmas you better hope you are not in Woolworth's position begging for customers

I'm going to try in the other Argos near me, I think there is a pleasant manager there - if no joy, I'll have to take the vouchers. I did look on Ebay, but by the time you've paid fees/paypal and the fact that today was the last guaranteed posting day before Xmas, I just don't think it's worth that route.

I can't see that hanging on to them in the hope that someone will want to collect them is worthwhile. Have you seen how much this game is going for at the moment? I think I'd rather be sure of getting the full amount back.:thinking:

Guaranteed Next day delivery is still available, post office on monday, to arrive on Tuesday. If they really want it before christmas, they will pay the extra postage costs

There is no law saying they should take it back. Infact the law is on Argos' side, as they are only legally obliged to offer you a refund if the product is faulty, not as described or otherwise missold.

Changing your mind doesn't constitute a reason for being offered a refund. Anyt places that do offer you a refund on it are doing it as a gesture of goodwill.

As for the 30 day returns, if its faulty and they say sorry its outside 30 days, thats against the Sale of Goods Act, within reason.

I work for argos, and I have got to say the way you have been treated is disgusting, take it back to another store, tell them obviously you realise its an excluded item, but its a genuine mistake, and as they can see its fully sealed/reselable. As long as you have a reciept it shouldnt be a problem. Good luck.

That's interesting because I asked the local Postmistress about guaranteed days for posting Next Day Special Delivery. She told me that the 20th was the cut off point for any Guaranteed deliveries - they couldn't guarantee that if I sent a parcel by Next Day Special delivery on Monday 22nd, that it would be there by Wed 24th. Was she incorrect?:?

Thanks for that Bryan! I am thinking of going to the other local store and asking for a refund. I think the larger store manager might be on a high horse of some sort - he told me I would HAVE to ask for him if I decided to return the items as it was him who offered the vouchers...needless to say I didn't ask for his name (but I'd recognize the mush again!!;-):w00t:

To be honest, I'm surprised no-one has offered to buy it from you already.

I suspect Loupomm was asking the price of the game.


My mistake, they are £29.35 each - don't forget I've got two I have to get my money back on. I'm not sure about the guaranteed postage, that's why I haven't put it for sale on here.. can anyone clarify if I can do Next Day Special Delivery and it will be there by Wednesday??

should be, i was going to say upon a thread in fs/ft and all relevant checks i would have it, but im not desperate and Asda do it for £24 odd i believe, when in stock, so i'm happy to wait, im sure someone will have it though

I'm sorry if it seems like that but I had the offer and I've been PM'd - I've been advised not to deal by PM and I haven't got the hang of selling on here, so I'm a bit slow in that avenue.
I will take this to fs/ft but I am still asking the question about refund/vouchers. It's still a debate as far as I'm concerned. :oops:

Actually, I think I'll just take them back to Argos and get the voucher - easiest option for me - I don't want to be taken the wrong way with what I'm trying to say. Thanks for all who advised.:thumbsup:
