question about play.com fuji camera at £13.49

Hi can anybody tell me if they ordered and received the camera Fuji FinePix Z10FD 7.0 Megapixel Digital Camera (Wasabi Green). at play.com for the price of £13.49.I ordered this item sometime ago and not received the camera but have received a email today saying it was put on thier website at the wrong price and has been cancelled.Do I have any rights.

i had same email - shame - as i want a really cheap camera to keep in car - we had a bit of a prang last week - and went into back of car at roundabout - no great damage to either party - said we were sorry exchanged names and thought they would ring next day for insurance details - they didnt - today we gets a letter from the police saying no charges will be taken against us!! really peeved at other party no need to go to police - they will most probably try to claim compensation for nothing!!

so i am going to keep camera and notebook with already written questions to ask - saying that we wont have another one now for another 6 years!!

rant over and i am still peeved not getting camera

sorry about the prang..surely we have some rights,if you buy say a dvd at hmv and it is priced at £9.99 but the real pce is £11.99 they would have to sell it for the advertised price.is this not a similar thing?? have emailed consumer direct to ask for advice so will wait for thier answer.

For cases like this a digital camera is not valid proof, I think something to do with the ability to easily doctor and edit images, your best bet is a disposable camera for £2/£3 tops. If it goes out of date before being used then that is good and no great financial loss also if your car gets nicked you havent got the hassle of whether its covered etc too.

HMV don't have to sell the DVD at that price. Most of the time they will to avoid any confrontations. But they don't actually have to.

Digital cameras and phone cameras are valid proof for claiming car insurance if you are in an accident.

I ordered this camera with play.com when the price was 13.49, but to be honest, never expected to recived it. However, I just login to my account, and couldn't believe my eyes! It shows "packing" at the moment! I will wait another day to see if I will recived dispatched email from them. And will update the progress if I know more.

Thank you for your enquiry to Consumer Direct. Your reference number for this case is SE486046 which should be quoted in all further correspondence regarding this case.



Whether, indeed, you had constructed a legally binding contract with the trader will depend on several factors. Firstly, whether the trader sent an email confirming your order or merely an acknowledgement. If your order was confirmed and the monies taken, then it could be argued that a contract was formed. Secondly, I would refer you to the trader’s website terms & conditions, which probably state when a contract is formed and by using the website and placing an order, it will be deemed that you have agreed to these absolutely.
It might also be worth mentioning that if you knew the cameras to be of an exceptionally low price and ordering two might be seen as such, that it would be seen as reasonable that it was quite clear that an obvious mistake has been made. Again I would refer you to the trader’s terms & conditions as to their stance in such circumstances.
Also, any offer of sale is seen in law as an invitation to treat and therefore the trader is not legally bound to sell the goods at the price advertised, or at all.
In conclusion, if after careful consideration of the above, you feel that a legally binding contract exists between yourself and the trader, by cancelling the order the trader only has to put you back in the position you were in as if the contract did not exist.

I havent played with it yet, but have had a quick look at the book.

I agree, you cant argue for £12.82 (take it you were cheeky and used the manchester met discount? Same here!)

Better camera than the one I have in one way at least because this one has a rechargable battery. One I have now is eating batteries at the moment! Bought some rechargable ones but still not great. In all other ways the camera is pretty much the same, although optical zoom is not as high on the new camera

What bugs me is we all know these deals are misprices so a good likelyhood they will get cancelled and when they do some people go into a strop saying the law says they have to honor the advertised price wasting trading standards time and that of consumer direct when they could be channeling the time/money into genuine cases!

To me its like a form of risk free gambling you either get a dirt cheap bargain like this or your money back! If an order gets cancelled you move on to the next deal.

But when a genuine member gets a real bargain like you did then i am happy for them, its the ones who order in bulk for ebay stopping others getting a look in that peeves me

I REALLY hope that they dont end up on ebay. Really annoys me that not everyone gets an item and the ones that do only ordered to make a profit.

Exactly, if its not something I have a use/need for it goes in the emergency prezzie box, I am useless at remembering birthdays, ive even been known to forget my own!! So having a box of back-up presents in a combinaion of male/female/unisex/and in adults and kids vaieties too. Ive lost count of the number of times my eldest two (5 and 7) come home from school saying its so and so's party tonight when they have had the invitation two weeks ago and "forgotten" about it

Because Parcelforce's mistake, I only recived the camera this morning. Haven't really got time to played with it, or read the manual book. To be honest, I don't really need a new camera, since my Canon IXUS 75 still works fine. I ordered this simply because I assumed it will get cancelled! I didn't even use Quidco! Luckily I used the 5% student discount. Anyway, will keep it as a gift, for now.

For the mis-price items, I never ordered more than one, and always keep it if I recived them. I can understand why some people order more than one (I think there was a person who ordered five cameras in this case), and I got no problems if they would like to sell for profits, but part of me just think it's not right. Anyway, I'm glad I got this.
