they would need to post it back to you before they would refund the buyer anyway...you should tell the buyer that you want them to send it back under a recorder/trackable service

although if they left you feedback saying the item was as described, i dont know, although paypal and ebay dont work together even though they are one

yeah but they said the item is as described on my ebay feedback.......which should be proof it was as described?

if i recieve it back and it doesnt work, wtf am i meant to do with it. It was fully working when i sent it.

saying it no longer gets a signal or something.......my partner used it for 1 or 2 month before we sold it....and it worked every single second until it left my hand....

Im gutted like ive already got 100's of pounds to pay out next week.

they recieved it, it was ok.........whatever hes done with it to break it, isnt my fault.

So i could buy a phone break it and 1.5 month down the line claim for a refund cos i dropped it and now it no longer works....

thanks...ill include everything.....i imagine ill loose tho as its my luck this year...:(

even if they win the dispute, they still have to return it at there cost anyway, so just explain everything in the dispte, nowt else you can do

As long as you haven't got any money in your Paypal account then it will just go into a debit balance if they refund the money - then they will give you some time before they start chasing you for the money.

i had a similar situation last year,with a mobile too,they elft f/b and then a month later started a not as described fault saying the phone kept cutting off,maybe they dropped it or something i dont know but i asked for the f/b to be taken into consideration but paypal ignored me and then refunded the buyer as soon as the buyer gave them the tracking number for sending back the mobile

oh and it got returned absolutely knackered,in fact i dont even think it was the phone i had sold them!

I agree...I know how you feel about these clowns.

I cant imagine they will refund the buyer if you let them see the feedback comment

...as before though...no refund until item returned...its also paypal policy to only refund the cost price...the buyer has to pay their own postage to get it back to you...again...go for recorded service

If the phone does not arrive in the same condition you sent it to them ie; they have broken it you will lose the money. Paypal nearly always decide in favour of the buyer. Although saying that I bought two faulty k800I phones once on ebay and the seller sent me 2 k800 phone housings. Needless to say paypal decided in the sellers favour on that one?!
The only thing i can say is good luck you are gonna need it!!

It's just horror story after horror story with Ebay isn't it?

As stated they have probably swapped out some of the bits into their phone.

Do you / can you stipulate in your auction 'returns must be received within 7 days of receiving it'

Don't know whether this would help.

Personally I wouldn't buy or sell such a high value item on Ebay now, too many scammers.

I tried so hard with paypal over my mobile phone issue,i got so annoyed they just wouldnt take note of anything i said and i hate having to accept paypal on ebay!

OOPS sorry Ebay states:The DSR's do not apply to private sellers, so for those of you that sell unwanted items as opposed to buying to sell you are not legally obliged to abide by the DSR's. You do not have to offer returns or a 7 day cooling off period
I still think paypal are out for all the heartache they can cause innocent sellers.

It's easy for Ebay though isn't it? makes no difference to them to make you pay the money back.

It's a no loss situation for them, unfortunately.

Make sure you open and check whatever they send you back, before you sign for anything.

A little advice to anyone who sells mobiles on ebay, Write down the IMEI number, That way you can tell if it's the same item, Same goes with anything else with a serial number.

I know this probably doesn't help now but hope in future you take the advice.

Anyone could have a blocked phone buy one on ebay and claim it was faulty, Keep the phone from ebay and return their original blocked phone for example.

What's the score if tazandsaz refuses delivery ?

Is the tracking good enough on it's own or do they need proof of receipt rather than pod ?

Not saying that's what taz should do, but is it an option ?

I'd get the item thoroughly checked upon receipt, let the buyer know that you intend to pursue for damages privately if you have evidence that they are at it.

So if buyer sends back an empty box (or brick) then it's a private matter for tazandsaz to sort out as they will have lost out on a phone and the cash ?

Yes I am afraid, same as if a buyer orders a laptop and gets a brick in a box, seller has proof of delivery............................

I always take down the IMEI now for all mobiles I sell on ebay before sending.

Similar happened to me, they left positive f/b for a phone, then raised a dispute for no reason, gave paypal all details including noting the positive feedback, they still gave them the money back.

Needless to say I wasn't pleased.

i offer free postage if Buyer pays by Cheque, Postal Order or Bank Transfer. If they pay by Paypal then my postage costs apply.

Its seems sellers are just ****** if something goes wrong, explains the huge decline in private sellers on eBay. You cant even warn others anymore as you can't neg a buyer.

Take all your cash from your paypal account, delete all the accounts & cards from your account, then if he does win, PP cant get the money from you :)

You cant delete cards or bank details from paypal when your in a negative amount or in a dispute.

The guy said he sent it to sony ericsson and they said the motherboard was bent? and that is not under warreny?

I was gonna write the IMEI number down and all other numbers....but my other half packed it up before i had the chance.

Just wondering, if i contact o2/cpw and ask them to tell me if the phone has made any calls since the phone was sent to the buyer. If they can send me a print out of calls made with dates etc meaning the buyer has been using it up until it 'broke' would this make any difference? cos he said it cant make calls cos of the signal, but if its been making calls then he is lying. also what if i can prove i used it to call someone the day i sent it....cos it was being used up until it was packed. that proves it worked when i had it.

Sony Ericsson phones have a 2 year warranty don't they?

How do you 'bend' a motherboard in a phone? Is there some form of sony ericsson repair documentation they can show you as proof?

as i always say though ebay SUCKS big time. i have only ever sold on their once and got a pittance after fees etc.
FREE ADS paper all the way, you get near enoughclose to, or asking price, no hassle as the goods are checked on sale And the buyer comes to you rather than having to post stuff off, best of all though it's cash and no fee's.
