I bought some games from Cex, but as they did not arrive i got a refund. But i did recieve another package with a psp with a cracked screen (no box or chargers) and two games. I presume that this package was from cex due to the type of label that was on the package. What i think happened is they got the packages mixed up and i got someone elses order whilst they got my games.

However when i first sent an email to them expleining what had happened they replied saying they would send me a refund (which they did), but did not mention what to do with the other item. Iv emailed them again over a week ago and still have had no reply.

So im stuck with this parcel and am thinking what do i do if they dont get back to me. I cant use it or sell it and then theres the small chance it was not even from them as all it had on it was the label with my name and address.

12 month warranty at cex but yeh get a full refund as cex is rubbish shop anyway!!

tell them if they don't pay for its return postage in say 7 days you will dispose of it as you see fit

iv got my refund but iv still got a cracked psp and two games to go with it. As im living in student accom, this package is getting in the way and on my nerves.

So basically what i want to know is if i can get rid of it sell it or give it away. Or could they come back to me in a couple of months and ask for it back or money in return. Basically its their mistake and its not like iv lied or am trying to scam them and keep it and iv twice made them aware of it.

And if i do send it to them, i would have to pay postage costs.

I think the items remain their property for up to 6 months. I believe though that if you write to them and give them the opportunity to collect their property if they do not collect within a set time then it becomes yours. It is not plain and simple though of how it is done.

Excerpt taken from a councils fair trading page
If the consumer receives unsolicited goods he can write to the sender requesting that the goods be collected. If the sender fails to collect within 30 days, the goods become the property of the recipient. Alternatively, if the consumer does not write to the sender, and the sender does not collect the goods within 6 months, then the goods become the possession of the recipient.

Thanks for that, didnt even think of saying anything like that. I will email them and give them time to get back to me and then i might just give it away - it has no use to me and i doubt anyone would buy it with a cracked screen. But it does power on and there are 2 games so someone could make use of it.

I just dont want them getting back to me further on down the line and asking me to send it to them or to pay for it instead.

i might be interested in taking it off your hands for free if i paid the postage. if cex dont get back to you but would have to have an agreement that my details you do not pass on to cex of where your disposed of it to as i dont want them on my case either

I think to be safe you have to send it in writing porbably recorded as i don't know how disputable an email could be

LOL - so youd have it but without the hassle. Ill email them on monday and give them 30 working days, so will see whether they want it back or not.

But ill keep you in mind if they dont get back to me.

Sell it on ebay, worth around £30 on its own plus what you get for the games

I have an idea, get involved in the fo.lk bandwagon and start your own campaign. Say if you win the ipad, you will give the package away to one lucky winner. Seems everyone is at it

They can't, it wouldn't be legal to ask for it back after an unreasonable amount of time, and the cannot charge you for it.

Boring stuff aside though, I just wanted to chip in that if they ignore your offer to send it back at their expense, you should take it into one of their branches. Might get a few bob for it, and it'd be worth it for the lulz.

Its been sitting in my room for the past couple of week and the other day i turned it on to play a game but did know how to get it to work. Not really into game consoles and only buy games from CEX for younger bro. But i felt guilty after as i thought should i be using it when it wasnt even for me.

Who would have thought that recieving something you did not expect would cause probelms. Its starting to get on my nereves looking at the parcel and i just want to get rid

You have had it for at least two weeks already? So less that a fortnight to go before the item can be considered your own.

I would be tempted to go into your local CEx branch with the packaging & any document(s) you have showing your name/address & say that you received the item but the screen was cracked when you opened it. Ask for a replacement :)

Given your experience with their customer services to date, by the time they catch up with their mistake you may well have left your student accommodation without a forwarding address anyway.

Couldn't agree more. If it was from them there should be some paperwork stating what was included etc. But if there was not then again furthers in your favour. :thumbsup:

It was signed for (not by me but someone else who was in). But i didnt order it and there was nothing inside the envelope apart from the console and games - there was no paperwork.

Updated:

Finally got a response and they said i could get rid of it any way i want. So i'll have to take pics and find out details of it (e.g. make and model type- as i know there a number of types of psp) . So i will put up for sale here in the next day or so.
