Returning something to tesco if opened?

its a ps3.... about 5 days old...

I think because you opened it that voids there return policy? As for the damaged box, they will see it as you opened it so you where happy with the product. Out of interest why you wanting to return it ?

Seen a better deal im not highly bothered but if it can be done id do it.

Ah it was also from tesco direct so i think the rules are different... cos the goods could not be seen in person...

It arrived with box damaged? You still opened and used it? But you're now claiming it was already damaged?
Why would anyone believe you?

I think its only returnable if faulty ( was a couple of years ago when i returned a faulty ds lite ) suppose it depends who serves you now and what the outcome , but you can only try and then if not go for the price match thingy !

Also phoned customer services , they go it can be returned(due to being purchased from tesco direct) I couldnt check instore because the box was wrapped in blue tesco direct packaging.

DSR does still apply if it was boxed damaged on delivery... but stating the obvious DSR doesnt apply if you walked into shop and purchased it (which you havent specified but based on presumptions you had it delivered). Did you sign for it boxed damaged ?? As far as DSR you are legally allowed to open the box and inspect the goods inside, just that when you return it it must be in the same condition as when you got it (box damaged or not). You may come into some complications if you didnt sign for it as boxed damaged but tbh ive sent things back that have been crushed in the post but notified the company i returned it to first. If it is within the 7 days you can always blag it and ring Tesco and say your other half signed for it, you have just got back from a busines trip to find it boxed damaged and are unhappy. You have however opened it to check the contents and it all seems ok, but you are unhappy and would like a refund.
