Robbed on ebay someone sent different item back and claiming refund.

Sister sold a tv on ebay the model no is FH-19LHDC brand new boxed and it comes with a built on dvd player (checked contents before sending off) got the tv free with a phone contract.

Ebay member called to say its advertised wrong as it didnt come with a dvd player built on. Sent it back and ive checked contents. Hes sent model no FH-19LHD back its EXACT SAME but without dvd player.

What ive noticed is the screws have all been tampered with as they are black screws with scratched silver in the middle as if a screw driver had been used on it. Also the front casing STICKS with double sided tape to the inside of the tv but its been ripped as if the tv had been opened leaving a gap around the screen edge (can fit fingers down it).

I decided to open it up and upon doing this ive now noticed damaged inside a few plastic bits snapped off and again screws been used and not even tight in the chassis. Further inspection i can see what from outside looks like a removable blanking plate where the dvd player should go but inide its actually not a blanking plate its part of the casing just looks like a blanking plate.

So the buyer thought he could nick the dvd player but infact you cant so hes swapped the tvs around.

What should we do now? i fear the worst on this one.

Check advice on EBAY re fraud cases.

Advise the purchaser of your findings and demand your TV is returned forthwith as you have their address ... or you will notify ebay / paypal / police

Then.... notify ebay / paypal / police in any event, as it no doubt isnt the first nor last time someone will try such a scam !

Nope thats her mistake already told her this. I suppose if he wants to lie to rob we can also steal pictures from somewhere else. But tbh i think shes willing to refund him to get it over with. Although i urged her not to, im abit more stubburn than her and i cannot stand a theif.

I'd send them a turd in the box and request a refund for postage.

Contact Ebay and see what they suggest.

Without pictures its there word against yours, more than likely sadly paypal with rule in there favour. Guess its touch and go which way a paypal claim would go, which seems the only likely option.

Make sure you tell paypal of all the damage etc that has appeared on a brand new tv, and hopefully they should find in your favour thought

You should be able to obtain serial number etc from your contract.... inform police etc... they willl see you are genuine from your "detail in the detail" and hopefully act promptly to get to their address to recover your item.. .unless theyre wise enought to have got rid already... but it sounds like they already owned one and was getting a free replacement out of you ?

did you not get an invoice with the serial number on when you first received the item?
Do any of the pictures you used on ebay display something different to the TV you have received back?

i sold a working xbox360 to someone who then said it was faulty and sent it back and i was going to refund until i noticed it wasnt my xbox at all as i took pics,logged everything so in the end he didnt win.moral of the story,always fear the worst when selling and log everything in detail.great at sending a big fu to the wannabe thief:p

lesson learnt really, take a picture of the item sent and make sure u record down everything. Unless u got proof of the details then its ure word against theirs.

i am assuming you took a picture to advertise the product on ebay? Does this have a picture of the dvd player?

DO NOT REFUND the item, and tell ebay and paypal about it. U just gonna have to fight this in the event it goes to paypal. Good luck

Good advice under normal circs...
but

TBH, this is likely to encourage them to get rid... if not already done so....

I would personally play it a bit niaive when contacting them until they agree to let you have your TV back,
( hopefully get it back ! )

& as i said earlier, TELL EBAY, POLICE etc ... so that they can "commence enquiries" asap to get ur TV back.... coz I'm sure this won't be their first / last time.. .& its likely to be the best way of gettin ur TV

Quite simple really, you have a pic of what you listed with dvd player and a pic of what was returned without, with no tranist damage but man handeled. Also where you purchased from pop to show what the item was, boxes with serials etc.

You MUST report it to the police for a crim ref asap you will get one and forward this to pp and phone, phone, phone them until resloved.


good advice - get the crime ref number and make sure paypal have it!

I think i will go down the route of calling the police then ebay then paypal, then the guy.

Ive searched the whole box and no it doesnt, however i need to get my sis to dig out the original invoice in hope the serial number is on there.

Sorry to hear about your sister's misfortune. I think you've been given the best advice RE: phoning police and informing seller that you will take matter further.

It might be of some interest to you that I once got scammed for an Xbox game on eBay. I paid £12 via bank transfer but never received anything. After I contacted the seller they told me they didn't have the game and told me to do one. I contacted my local police and they personally visited me to take a statement and evidence. They investigated the matter and one phonecall later from the police, the matter was sorted amicably. I received a cheque for the £12 a couple days later. Happy days!

I have nothing but praise for my local police, makes a change from the Avon and Somerset Constabulary who've been nothing but useless when dealing with them for much more serious crimes.

You have thier address, just go down there with a few of your mates & "kindly" demand yout TV back & also keep his money !

Im south of england he is north of scotland.

Gone to the police and they advised to call him to sort it as they cant do anything as its not a police matter. I called the guy and he assured me its not been swapped or anything, think hes about 60 or 65 but the tv didnt get delivered to him it got delivered to his sons girlfriends work place so it went through his sons hands first. Hes claiming he recieved the tv and unpakced it and noticed it didnt have a dvd player so sent it back.

Tbh i think my sis has messed up big time in every step of the way with regards to backing herself up. Too trustworthy.
