As the seller, I posted an item on 17 november using RM recorded service. Item cost 78p + 72p for recorded.... in total, £1.50.

The buyer received the item, but because HE never signed for it, he is demanding money from me, saying he paid for recorded delivery but thats not how he received it.

Who is in the wrong, and is he in his right to demand money from me? He says I have to send him £1.50 then claim back from RM?

I've told him he aint getting any money back, and that, it aint my fault if the postman never knocked on his door.

as long as you can prove you sent recorded then the buyer hasnt got a leg to stand on

Take no notice. If you still have the RD receipt then you can give eBay the info if he starts causing problems.

It's very hit and miss with us if Postie asks for a signature. Tell your guy to get lost. He can see from the parcel/envelope that you paid for it to be sentt as recorded as there will be a sticker to prove this.
Personally, I'd ignore his e-mails. Was it ebay?

tell him that as he was unavailable to sign for the item he is now due you £1.50 as is was signed for by someone else...see what he says to that!!ignore him,if its ebay put him on your blocked bidders list and leave feedback accordingly...
if he claims he doesnt have a leg to stand on as you addressed it to him(the registered address) and sent it via recorded delivery..paypal wont accept his claim...he can do nowt..tell him to bolt!

but if the parcel was paid for using royal mail online with paypal then op has the info to prove he sent recorded, plus it will be trackable on the RM site

the buyer will have to take a leap

he wants his money back cos his postie didnt get him out of bed & talk sweet nothings to him :whistling:

thats all well but if the postie put it through the letterbox without getting a signiture then it technically didnt arrive and was lost in the post which is whats happened to me on a few occasions with ebay/rm where paypal refund the buyer for not having proof of delivery

if you check all the recorded items you have ever sent you will find a lot of them dont have any record of bring delivered on the rm site...

pain in the postiere coz you have to claim with rm and have to prove how much it cost you to buy not what price it was sold for and thats the compensation u receive

Simple, claim the 70p or whatever for the recorded part and inform the buyer you'll be passing it on if and when it's received from RM.

Send him an image of the receipt. Suggest he takes it up with the RM or better still tell him to look where the sun don't shine.

Surely he has a right to ask for a refund of the recorded service seeing as he didn't receive the service he paid for???

There is proof of delivery. The buyer has admitted he's received it.

You are confusing receipt of postage with recorded delivery (which this was sent by.) The full postal address is recorded on the recorded delivery receipt.

He should take it up with the seller, seeing as the seller will have the receipt and paid for the postage. The seller should claim from RM and refund the buyer when the claim has been completed.

Not proof of delivery in paypal's eyes. I know what you mean but paypal will likely not see that as proof of delivery, rightly or wrongly.

Dont agree. If he wants to pay for his time and effort to chase up the post office to recover 72p and for posting the refund, then fair enough. The buyer paid for a service and the cost for this was paid out by the seller.

He knows it was sent recorded - it had a sticker on the package - therefore complaining to the seller is out of order. If he has a moan - that should be directed towards the post man for failing to do his job properly.

End of. If he isn't happy with that, I'd suggest the buyer takes it up with a small claims court. All things being considered, he might just do that - and we could all do with a good laugh.

How would correspondance stating that the goods had been received not be proof? I know Paypal and nuts - but they are not that stupid. Are you suggesting the guy is now going to register a despute with Paypal for non receipt of goods? That's the only way it would be progressed - and I'm sure you would agree fraud is illegal!

If you are saying the parcel didnt arrive or arrived damaged, I'd take it up with the seller. If it arrived safely with the wrong coloured stamp on it, I'd not do a thing about it. Life is too short to worry and get stressed out over 72p. You might disagree with that, but thats your perogative.

In short, the OP has already stated he has done his bit and its not going to do anything more than he has. I 100% support that view. It's fine to complain, but lets be fair, do so when their is a real reason.

I've never suggested that from a legal perspective, the onus is on the seller, purely because he has paid for the "contract". (ie the stamps and recorded service.)

My response suggesting the buyer complains to his post office was to ensure they know what they are doing and do it right next time. Thats not the domain of the sellers!

My reasoning is sound. And to be honest, I'd just tell the buyer to F off.

i sent halfords vouchers and he said he's received them.. its the fact that he never signed for them thats the problem! and thats MY fault. I posted it myself so know it WAS recorded (hence the £1.50 cost)

You went to the post office and paid for recorded - fact.
He has received his vouchers - fact.

You did what you said you would, you fulfilled your obligations, and he has his vouchers, that should be the end of it.

All this about 72p and a signature, jeez, has the credit crunch hit people that hard?

im saying that on the recipt that you receive for sending it recorded sometimes thry do not put the postcode on that receipt!

and nowhere does it have the full address matey!

also paypal require proof of delivery not proof of posting and the buyer leaving feedback or sending a message saying it has been received proves nothing im afraid as this can quite easily be forged.

i have known buyers to leave positive feedback about quick service etc then put in a claim for non receipt coz rm hasnt bothered to get a signiture which is whats required.

another thing having a recorded sticker on the package/envelope means nothing as they can just be stuck on and not scanned and registered believe it or not....

Recorded Delivery is an 'insurance' for the seller, not the buyer. No need to have any further discussion with him/her. If there is any issue, let the OP take it up with Royal Mail.

Then instruct them to do so if they've been lazy and havent. Not too difficult is it?

OK..... So you told RM that this guy has stated he has received it and you are having to make a claim because he's said they have failed to deliver? And their reply was?

Eh? Whats that got to do with anything? The buyer received the goods and complains he wasnt made to sign for it. He knows full well it was sent recorded despite not being asked to sign - purely because it would have had the sticker on it. Or are you now trying to say the postman not only failed to ask for a signature, he also peeled off the sticker as well? Strong conspiracy theory!

Correct. And since the claim that private PMs cant be used as evidence because they can be forged - the same applies to his request via PM to send them recorded. He certainly didnt state it on this public forum in his offer. In fact I'd suggest the mods look at this carefully. Clearly the buyer didnt follow the forum FS guidelines by trying to take it to PM.

No, thats not the purpose at all. Recorded delivery is to get a signature. It doesnt give any further insurance value than sending it with a receipt of postage (which is free.)

You're saying "if there is an issue" as far as the OP is concerned, there isnt an issue. The goods have been received. If yiou would waste your time to go in a queue in a PO to get back 72p and then waste money in posting it on, then more fool you. The OP paid the fee - its his contract - he's happy the goods have arrived. End of story.
