Hi guys, any help would be appreciated,

just to cut a story short, bought bad company 2 from sainsburys for £39.99 yesterday, removed the shrink wrap and played for an hour, didnt like the game and tried to take it back today with the receipt,

store person said they couldnt give me a refund because the shrink wrap had been removed and i may have copied the game.

any chance of getting a refund?

if not, how much do you think I could get for it on here? i know id have to wait 7 days before listing.

No chance as you may have used the code as well and had the game for a full day so you could well have completed the game and brought it back.

2nd hand you'd get about £25-27 if code was used or £27-29 is unused as can be had brand new for £31.44 at tesco entertainment

so is trying to pass something off as new when it has been used - would you buy a game from Sainsburys without the shrink wrap?

i think even if you say its faulty they will only exchange it for the same game, but then you would have one with the shrink wrap on, so could try taking it back to same store few days later saying you got it for someones birthday but they already have it.

just say it freezes at points and thus bought it elsewhere to replace it as it was a present for your kid or something and couldnt get back to asda to exchange it. :whistling:;-)
Furthermore, if they insist on replacing it...you have a new one with shrink wrap on!

What reason did you give when you returned it? If you said you simply didnt like it I doubt they would have given you a refund. In fact im sure they wouldnt have!

I've purchased PS3 games from Sainsburys and they've not been sealed... I think it's who you get at the returns desk.

Copying a ps3 game...? you'd be a rich man...

Sainsburys will mark the exchange on the receipt.

thats what i said to him and asked for his manager, and he said there was no manager around,

i might go and say its faulty and if they argue quote the sales of goods act lol, worth a shot i guess.

Yeah as it's a one use only code so if they sold it on after you brought it back someone would be done out of some online content. But if your saying its faulty I guess it wouldn't get resold anyway

I noticed that no one answered this but yes, it is fraud. Unfortunately your chance of succeeding (at least for getting a replacement) is fairly decent, because even though stores know that people do this they are not in a position to practically prove them wrong.

I am always surprised me how people's default reaction in these situations is to defraud the store that sold them the game originally. The store is then left with a so called 'faulty' game that, despite working perfectly, is effectively useless stock that will be returned to the supplier. Such a waste, all because of customers refusing to take responsibility for their own choices.

So you bought a game, played it, didn't like it, tried to get a refund on the now second hand game and because they said no (quite rightly, they now can't sell it as brand new) so you want to lie and say it's faulty when it isn't to get your money back?
Am I the only one who thinks this is wrong and you should just either keep it or sell it on as second hand?

Give some of us a chance... I've only just read the thread!

Yes, I am with you... it is not the Store's fault you picked a game you did not like.

If the item is faulty, you are entitled to an exchange for the same product. If this is not available, an alternate, similar product may be offered to you, you may take a credit note, or you may be refunded completely.

If you speak with a representative (Manager, or whomever) then you may be able to persuade them to refund you completely, but within the Act of Goods & Services the retailer does not have to. The Store's policy may be different to their (minimal) legal requirements.

Of course my post was entirely without prejudice to those who may post afterwards, FP, and indeed I would have expected nothing less than you posting exactly that had you got there before me :)

I believe so, and good choice.

I wish i could just send back every PS3 game i purchased that i didnt like :whistling:

Why not try the game out on a rental for a night, at say Blockbuster, before you decide to part with your forty bucks next time ? Sorry but im with the rest here... you buy it, play it and then decide you dont like it... hard luck !

Sent back to supplier who then test it and repackage them to be sold again if they test ok...
Source = I worked for Technicolor Distribution in the Quality Returns Department. We dealt with DVDs, HD-DVDs, Blu-rays, Games, etc. All the 'Faulty stock were piled separately to be tested at another warehouse and if they were fine were sent back to us to be packaged and distributed to another stockist.

I am not disagreeing however re. defrauding.

Just what I was about to say - just because you didn't like it doesn't give you the right to return it. Do you do that with your cereal or anything you don't like - take it back? This is a wind up surely. Can't believe people are even telling him what he should do with it - the word numpty comes to mind

I bought Fable II on launch day, tried playing it on my lunch break and hated it. Decided to take it back to Sainsburys later that evening but for all my charm I couldn't get a refund.

Didn't purchase it sealed as the case had been on display and the game stored in a sleeve.

The decision to sell to me, or the decision to not take it back! ;)

Seriously, though, yes, the 7 day period (still) exists. If I had the time to wade through the appropriate thread I'd check if there is a case for you responding to a "Wanted" thread that a member (i.e. me) may place in the meantime but, even if my offer was not what you were hoping for, please just let me know when you have listed the item for sale (next week).

Thanks.

A few years ago I was discussing this issue with a Store Manager in a branch of GAME.

Back then they had a policy where they will accept an item back into stock 3 times. If a fourth customer returns the same item [I wished I'd asked now how they tell] as being faulty they then write it off completely. Literally just dropping it in the bin!

Such a waste. Granted, faults do exist... and I do know some people who did return their own "Battlefield: Bad Company 2" item because the online experience was poor at the time they played it [it has got a lot better now, but it still has times when I cannot get a full game without being dumped back to the main menu].

Yeah that doesnt surprise me either as I remember buying preowned games from gamestation when they first started and they wouldnt work in my system but would in my mates yet mine was newer! It was crazy, but shows it can work in one system and not another...not that often nowadays so much I think but it can happen.

That sounds annoying! I hated when I tried MW2 online on the PC that if the host has a problem you get dropped as well! Spend half the time finding a good game!
