Scammer on ebay selling xbox live codes digitally - refund?

I bought an xbox live code from ebay from a seller who had 299 feedback and had a history of selling other xbox codes left in his feedback.

In the description he said that he would send it on the same day by email. I wanted it fast and I have done that on the request of a buyer a few years ago. He had 7 for sell, I bought one and I thought I should get it later. Later in the evening I emailed him, no response. The following day I still have not received the item or an response. I check my purchase history and notice that it say's that he has relisted the item, he relisted later on the first day 7 more times all sold. I then saw that it said "this item has been relisted again" click it and he's got another auction on and 3 have sold and he's got more left.

I then look at his feedback to see if anybody has left feedback... nope, I realise it must be a scam, I tried to report the current listing to ebay but they make you select pre defined options. Today I look and I see that he managed to sell 13 more live codes and I see that his feedback has lowered to 288. People have started leaving feedback saying that they have been scammed, no resonse from seller etc.

I can't open a case in ebay until next week Wednesday as I tried and it said I must wait until then. I think the seller probably set the estimated delivery date as far as he could to make as much as possible and so that nobody could open a case.

Looking at ebays price promise after having no way to actually report this to them, it says that digitally delivered goods will not be covered. The guy made it clear in his listing that he would email the code and that he wouldn't send anything so where do I stand in regards to getting my money back?

I also see that he was selling the xbox codes to use to buy things during this period under the same "send on the day by email" tactic. Is it worth doing a chargeback through paypal? or should I wait until I can report it to ebay on Wednesday?

hello

if he is not a Top Rated seller (business account). he is not allowed to send the code digitally. Buyer protection should have you covered as he should be posting this, not emailing.

I doubt top rated sellers are even suppose to send it digitally.

Paypal will NOT refund because like you say a digitally received code is NOT "tangible"

Next time try cdkeys most probably cheaper & reliable, unlike Ebay.

I would also contact the police as people like this deserve to be caught as they spoil things for genuine sellers and buyers, and if more of them are caught it may deter others from trying to scam people

So, I've just had a google and it says that xbox live codes are not allowed to be sold digitally on ebay.

These are the postage & packaging details of the item.

He also the listed the item under NEW condition.

As he has clicked those conditions to put his scam ad up, shouldn't it be possible to say that I wanted to arrange collection and I have had no reply etc come that date I'm allowed to open a case?

Also if I try to put I haven't received my item it says under the contact a seller option

Ignoring what he said in his listing as he's not allowed to sell like that and given the options that he chose. Could I do a chargeback on paypal without going into the details? basically say item is not received / can't arrange collection. I don't know much about how a charge back would work in this case but I've heard that people have been scammed by people doing charge backs in the past. So couldn't I do something like that to get my money back from this scammer? he must have made a lot of money. He's got about 20 negs today for loads of items. 3 months live, 4200 points, 12 months live.

Just my luck, randomly that day I thought it would be nice to get this for my sisters as they have an xbox but no Gold. After I had a quick search on here I thought I would check ebay saw this one had a quick look at feedback etc, bought it. A little while later I saw the new deal on here for xbox live from cdkeys but to late, cheaper by a quid too, but I did think atleast I'll have it today...well, well, well.

wont ebay just refund you and and claim back from the sellar?

Ebay always side with the buyer and with an item he is selling digitally which ebay say not to do i cant see the sellar getting away with it

If you initally said you would post, post it! dont get me wronf i prefer instant codes but for your own protect post and recorded delivery it.

I've had a similar scammer with good feedback selling actual discs for games. Good feedback, I pay for game, didn't show up so I emailed and got not response. Looked to find that all of a sudden he has about 20 neg feedback for different types of games. I can't open a dispute until next Weds even though it's obvious he's scamming and not going to reply. I want my money back now as I still have to buy the game elsewhere :(
