Anyone ever done this? taken a small claims case out on someone. how do you go about it?
Ive recently had a transaction on here where im convinced i wont receive the goods i paid for. Its only £20 however theres many others on there that havent received there good either. No reply to Pms or emails or phone calls.
We have his email, address, number etc so could make a case just wondering how to go about it and is it worth it?

i have done it before (not for on here) after a wheel fell off the pushchair i brought out the local paper the first time i used it cost about £25 but got that back when i won

He hasn't been online in 5 days, and it's only been 8 days since you agreed to buy. I only just recieved a parcel from here from the 25th November yesterday! Could be the weather?

EDIT - Just seen Adam say he responded 2 days ago, stupid HUKDs saying he was last active 5 days ago X)

The minimum fee is £25 for an item that cost £20? am i right in thinking even if you win you only get your £20 back? so would be minus a fiver? or do they have to pay for the covering costs etc?

You get to add on the court costs to the claim so the amount owing would be £45.

is most likely the weather to be fair. i bought uncharted 2 off the same thread and i really think its too early to panic. my postman says they'd be lucky to clear the back log from now before christmas. let us know if you hear any thing but i think you'll be ok

Even if you win there's no guarantee they'll pay. I'm in the middle of a case at the minute. I'm owed £500 and the fees are now up to £145. And, as it's been going on nearly a year I'll soon have to pay another £100 as the warrant will run out. It's time consuming and if it was for a small amount like £20 I wouldn't bother.

I have to agree i'm still waiting for items ordered online from the 30th of November ! 2 days off no moterways and the whole of Englands parcel service has fallen to it's kness (_;)

i wouldnt open the claim yet i just wanted information. Ive sent 3 PMs with no responce. no answer on phone number or email. His also jsut received a negative which isnt a good sign. Dont get me wrong i hope i am wrong and i get the items and it is the weather but i wanted to the information, even if this case goes well its good to know.

I think all my parcels sent have turned up so far so I think it's totally dependant on area, I'm still waiting for collection for a parcel to go off today, as the Collect + service wasn't active.

I have a mobile number for the seller which I will pass on to the mods now.

Can double check them agains't the ones I have if you wish, as I said Galaxy was fine with me, I did ask for postage first but he still didn't have to send them and his comms were always honest, though he still hasn't figured out feedback :)

I'm waiting for a parcel that was booked for delivery last monday :( over a week late and they still won't say if it will be on the van tomorrow.... they did say the collection office is now open but has very long waits as everyone trying to collect their stuff , i can't win..... wait forever for them to deliver or drive 20 miles and could have to wait for hours!

Had a brief chat with the DHL guy and he said the collection system has only just come back on today and they have a massive back log.

That gives me hope then that DHL might collect the parcel that has been scaned for collection by Bestbuy, otherwise my 10 year old son has no christmas present :( getting worried again though as snow is due again on thursday.

DHL in my area are currently running 5 days behind at the moment. I also normally get my pay slip on a friday but it didn't come until monday (was sent first class on the thursday). Also waiting on items from play that were supposedly posted over 2 weeks ago now.

Mate of mine down here works as freelance courier.He was only telling me before his boss's phones are ringing non-stop with offers of sub-contracting work from larger delivery firms. They are declining most of the work as they are already a few days behind keeping their current contracts happy. Anyway, he was saying it is now much busier than last year, even with the royal mail strike that went on.

I'd deffo give it a bit more time.

I ordered from Cloggs since 1st Dec, and has no delivery at all, even the tracking number doesn't show the expected delivery date.

Royal Mail seems to be fine for me in Manchester area.

I guess just give it a bit of time

Crikey! I still havent done anything (apart from contact seller) in respect of an item bought from ebay (with next day delivery!) for something bought over 2 weeks ago.

OP.... you do know we've had lots of snow putting deliveries behind anyway - and thats without the additional post for this time of year? I'm waiting on loads of stuff. Be a bit more patient.

I'd not be too please at being accused under these circumstances!

You have to wait at least 15 working days for Royal Mail to even consider the parcel lost. So OP you should at least wait this length of time, then if no luck, or communications, then go down the route you want to take.

I wondered when the idiots on here would start! Regardless of postage the bloke will not answer pms, emails or voicemails on his phone! Must be the snow I suppose blocking his signal on his phone and wifi :S if you trade on here and take peoples money you should be online to speak to them!!! So stop being so stupid blaming me for posting this! If I want advice I'll ask for it! I don't need you mod wannabes permission!

I've taken advice. I understand it would be to early to make a claim which is a fair comment but I just wanted advice. I'm off work this week so could look into it. Im working 13 hours shifts over Xmas so I wouldnt have had time to investigate it. That's why I asked for the advice now
