actually you are aiding a sale of restricted goods to a minor - there can be no "thinking" - you are as liable as the seller as I see it on a brief look through page after page of legal crap.

It only takes one incident, and technically, HUKD has helped a user break the law. That can't be right can it? I know its no different to amazon for example, but they do at least have a "you agree you are over xyz" type message

Yes, if you want to sell that sort of film (as long as it's not a
sexually explicit item) and adheres to the remainder of the fs/ft rules.

actually you are aiding a sale of restricted goods to a minor - there can be no "thinking" - you are as liable as the seller as I see it on a brief look through page after page of legal crap.

It only takes one incident, and technically, HUKD has helped a user break the law. That can't be right can it?


Our clear instruction is that these items can only be sold if the trader is satisfied that the person if of an age to purchase these items. If in doubt then you should refrain.

If this is abused in anyway, then further restrictions will be considered.

So why cant people sell (for example) jelly dildos to over 18s? as long as they are happy the buyer is over 18?

If the thread title is the issue - perhaps say you just have to put "FS: adult goods (OVER 818)" etc

I can't discuss another members account with you, however that particular thread was locked due to the flouting of the age rule. The member did not care how old the potential buyer was, It is exactly that sort of action that will result in a further tightening of the rules.

No infraction issued on that thread, although it was also locked on the count of being overpriced.

t0mm u dont have a leg to stand on with this one, dcx was a bit careless, and overpriced the dvd, dcx clearly made out that she/he would sell to anyone of any age, thats not very responsible is it?

I assume then he was infracted for creating a new thread after you locked his first "why was my thread locked" one. However, that thread was almost immediately unlocked again. isnt it a bit mean to infract him then, considering, I assume, you shouldnt have locked that thread anyway? )im talking about the 2 misc threads, not the for sale thread as youve said he wasnt infracted for that)

We don't think it's responsible for members to potentially sell sexually explicit items to minors. This may happen if such items are advertised through the fs/ft forum.

Anyhow - who wants to buy these sort of items potentially 2nd hand. There has not been a large volume of these sort of sales, so not too many people are caught up with this restriction.

We can't discuss, however I'm sure the member will share the news with you on his/her return. There has been nothing posted publicly that merits an infraction.

I don't know if Admin(s) are around. They will deal with issues requiring a 2nd review.

Thanks for the 'Age Rating' however this site is not constrained by those 'laws'. We have our own set of rules and principles. It is those that need to be considered and respected. Simply, something being lawful may not be desirable here.

1) But its not responsible for members to potentially sell over 18 dvds to minors either. For random example - Skins DVDs. 15 or 18 I think. Sex and drugs all the way through. I don't really see where the line is, or why there should be one.

2) I totally totally agree, but is that really a good reason to bring in a restriction? Because it wont affect many people?

(sidenote: are we allowed to contact admin asking for a second opinion on another posters infraction (based on the details I posted above?)

I'm off to bed now, but this one is gonna run and run... the rules just dont really make any sense at the moment...

He did indeed say he'd sell to 'any age'

But he also said he'd accept paypal as the method of payment.

According to paypal rules you must be 18 years old to own a paypal account therefore the future buyer 'WOULD' be 18 unless going against paypal rules - but i'm pretty sure this is enough to 'consider' someone as 18?

1. Agreed, not responsible nor do we want this to happen.
2. We would rather not detail every exception, but we're pushed to it sometimes in order to demonstrate consistency rather than mod discretion.
3. The reason for infraction is not anything to do with public posts/threads, so I see no merit in that one. However Contact Us or Feedback is the appropriate channel.

Yes noted, however we act on principles and intentions. Trying to evade these by means of a technicality may work in a court of law, but this site has it's own rules.

This doesn't seem like a rule to me, just a suggestion

As its perfectly legal to sell any dvd (assuming it doesn't fall foul of child protection laws) to anyone of any age, how would members know they aren't allowed to sell to under 18's?

If I wanted to sell a knife, I'd need evidence that the person I'm selling to was 18 (or older), even if the knife was for cutting a loaf of bread.

Surely when you sign up and to all existing members of this site - the DOB thing will have to be a mandatory thing and something enforced like background checks or whatever to prove it is correct.

Heck, if my 2 year old (FOS) could type like a pro on the computer, log into paypal etc.. and buy something off here (let alone understand some of the technical blah blah that people post on here) I'd give him a pat on the back:thumbsup:

Do you believe he actually had the DVD to sell? The thread was submitted 6 minutes after a mod posted a deal for "The Shining". Coincidence?

It was a protest thread that would push genuine FS/FT threads down the boards.
