I have just spoken to a girl called Ciara from Play.com and she has assured me that nobody will be getting the box set at £9.99 - I said that some people have had confirmation emails, but she checked with a manager and they said they are not honouring any of them!!

Sue them, get citizen advice involved, take it to the small claims court, Its the law i have a email, they have my money :roll:

It really depends on which confirmation email people are on about. If its the 1st one confirming your order then you have little chance as they haven't taken your money.

Even if you have an online bank or credit card account that says the money has been taken that still doesn't mean they have taken it. Alot of companies ringfence funds i.e. they carry out the 1st part in requesting to take money from your card and your card company duly says yes you can here is an auth number. Unless, the company settle and send that auth back (can be up to 2 week later) saying yes we will take the money then NO contract has been formed. If they don't settle after about 2 weeks the ringfencing gets lifted by your bank as they assume the company is not going to settle against it.

Yes, its annoying as it means you pretty much have to wait until you get email number 2 saying they have debited your card. At that point a legal contract has been formed and yes go for broke on getting it.

I just called 999 but they didnt seem too interested, i called 911 too but they said they dont deal with matters this far east, does anyone have anyone else i can call!?

Even if they still take your money the contract is not legally binding until the goods are in your possesion. The law even gives them up to 28 days to return the payment before further action can be taken. Which is why i rarely deal with companies that take payment before the goods are dispatched, eg Empiredirect. I found this out to my horror when they did one of there famous misprices and it took 7 days to get my funds back and they were quite within their rights to do this.

Surely most people ordering it knew play would not honour the mistake. I knew that when I ordered one on my main account with play, and 50 of them on another one.

There was a pricing error, and they cancelled orders because of it. I'm sure people will still order from them in the future if they are the cheapest.

Because on a misprice of this magnitude Play have been known to offer goodwill vouchers to compensate for their error.

As most of us think it was Play behind this whole fiasco then there will be no vouchers as it's probably a marketing ploy.

As for mr post no 1, no way did he get a confirmation, he's trying to get your backs up so why rise to it?

go back to them - they offered it at that price, you accepted - even if they say invitation to treat (suprisingly a legal term), you offered to buy and they accepted.

This is a valid contract and they HAVE to go ahead with it.
