I sold a phone via HUKD at the end of October. I had a few issues with the buyer, i sold the phone as unlocked, but it appeared i had not unlocked it properly. I sent him instructions to do it for free online but he did not seem to be able to do it, so i gave him a partial refund to get it unlocked in a shop.

He is now claiming that the phone has been reported lost/stolen and has threatended to go to the police if i do not give him a full refund. I am 100% certain that i have not reported the phone lost or stolen as i am not that kind of person, I would not want to have to deal with the agro it would cause me, it just wouldnt be worth it for £100.

I received the phone from Orange (brand new) on my contract (which i am still on). I still have the IMEI number which i provided orange when i got the phone repaired by Sony Ericson at the start of Oct.

To me this all smells a bit fishy since its so close since Christmas, so to me it seems as if the buyer is trying to pull a fast one on me.

Where do people think i stand?

Give him your address details so he can hand them to the police as well.

If its as you say, you have nothing to worry about. If he's tried to do something (like change the IMEI and messed it up, thats his problem.

Who was it anyway?

if you have done nothing wrong then let him go to the police-if it isnt reported stolen they wont be interested will they?

I echo what the others have said, let him go to the police, if you haven't reported the phone stolen then you have nothing to wory about :thumbsup:

If you have done nothing wrong then refuse to refund.

Let him go to the police or take action against you,if you are telling the truth he will lose

if the phone is in your name then call orange and ask them is it blocked and if so why? its on your account they can tell you? this phone could well be blocked..am IMEI could have been reported stolen and inputted incorectly? if its been blocked for this reason orange can unblock it? its worth a try...

If he has been using a sim card in it that has been reported stolen it will also have blocked that phone as well

I'll reply back in here once i get a response from Orange or another one from the buyer, i have told him that he can go to the police as i am 100% positive that i have not reported it lost/stolen.

I would have thought you would want to speak to someone quickly regarding this matter. There's not a cat in hells chance you'll get a satisfactory response to your query via email.

I have the email of a team leader at Orange customer services, he sorted out a refund of Special Delivery postage and 1 months contract fee for free when i had to send my phone back to SE.

As pointed out - why not use straight away, get your story sorted, then inform the mods/members here if required.

hmmm, how can he report it stolen if the phone is in your name? I wonder if he has made a mess of unlocking it and is making attempts to obtain a refund. Sounds like a civil matter to me at best. He has clearly received it, so who has lost it? or had it stolen from them?
is he suggesting you sold him a stolen phone? easily proven to be false by yourself I imagine.
If he came to me with this, from what you have told me, he wouldnt be getting very far without backng his claim up with some sort of evidence. Attempting to pervert and wasting police time could well cost him if he is being dishonest.
There could be an error at orange, I suppose, it does happen. The civil side of things would be selling it as unlocked when it wasnt, this would have to be sorted out in a civil court and nothing to do with the police

it has been a misunderstanding i am chattin via PM with the seller.. i am goin to send the phone to sony ericson and get it repaird. thats if the seller offers to give me a copy of proof of purchase...

I know someone who has ordered a SE mobile, tried to unlock it, bricked it, sent it back as broken, he got a replacement free of charge...

Unfortunately that has all sorts of retailer/consumer laws and companies with budgets in place to do that kind of thing, private sale is another thing entirely.

I reckon he's bricked it and is blaming you.

I wonder what the misunderstanding was? All sounds very dubious to me.

the phone keeps saying no service.. i assumed it had been blacklisted.. the phone was unlocked in october a week after i recieved it.. so it cudnt have been that.. i have contacted SE and they go we'll repair it under the warranty if you have proof of purchase of any document that was sent with the phone..

unlocking it via an idependant shop[ rather than orange voids the warranty i think
