OH was in a car incident, about 16 months, still dragging on.

She goes through Tesco insurance, and was assigned Cogent Law as her solicitors.

She's been sent a letter a few months ago confirming time and place, also advising more information to follow.

For the last month she's been passed around with everyone being as un-useful as it gets.

The hearing is next week, and the person to who she needs to speak won't take her call / call back.

Any ideas on what to do next? As it seems clear, they can't be bothered to deal with this.

These claims do drag on and it really depends on the severity of the injury as to how long it can take. Have you had a medical examination and report? Have they admitted liability? Has your solicitor put an offer across to them? Was this accepted? Were you at all at fault? These claims do not (unfortunately) just get paid out over night.

Also, it is worth emailing the person acting for you as opposed to calling.

The other party is the defendant,

I forgot to add, probably the most important piece, this is a reschedule, the other party cancelled 4 days short of the hearing due to having an 'exam' that day.

He also didn't report the incident, failed to reply to the insurance company within the specfied time frame, and was given an extension. The other party are dragging this out for years.

Its more a question of is there anyone else to contact? CAB? Court themselves perhaps?

The court or CAB will be of no use to you as you have already instructed someone.

The solicitor would have sent to you a "Terms of Business" letter or they might still be calling it a "Rule 2" letter. In this letter you will see who you are able to complain to in the event that you are disatisfied with their service. That is definitely the next step.

If it is clear that the other side are liable then I wouldnt be too concerned that the hearing was cancelled. At the end of the day it is their insurance company that is going to pay out and not them. The only repercussion for them is higher premiums and loss of no claims.

Purely damage costs, as it's the other parties fault.

Tbh, it's on private property (Bowling alley car park) So probably should be 50/50 regardless, but there you go. OH doesn't care anymore, just doesn't like the fact she can't go through the case with her solicitor because he's gone awol.

Ignore my advice about the injuries but the advice about the Terms still stands.

OK this is what you do mate, get your wife to call in Cogent and ask to speak with the complaints handling partner, if they dont put you through, ask for the direct dial and email address. You send the complaints handling partner a stern email saying what the issues are and cc in the solicitor handling the case. You watch how quick they get on the phone to you to sort your issues.

The unfortunate reality is that because this is a small claim, there is very little to be gained by the solicitors dealing with it, therefore they do no tend to use a lot of their resources keeping client's up to date etc

Its prob best to give them a call to get the details OR if you recieved a client care letter from the begining of the claim, that should give you details of the complaints handling Partner or at least the complaints handling procedure.

BTW, that issue with eBay part on my car is dead in the water, have got manufacturer to pay for a new part - result - cheers.

Just wanted to add to this thread that I'm using Cogent Law through Direct Line.

They are almost impossible to deal with, do not return calls, do not read supplied documents in a reasonable amount of time and don't seem to give a monkey's. Cogent Law appears to be a battery farm/call centre for solicitors who might individually competetant but are rendered almost useless by sheer workload.

It's not good and it's beyond frustrating.

cogent law are at present, handling my interest after a non fault car accident. So far they have lost or ignored my correspondence. Lost important documents that I need for income tax purposes. (All sent by recorded delivery), to safe guard being lost I the post. I have complained by Email, but no reply as yet. I now realise I should have gone to a local solicitors practise, where one can drop in for up dates.( We live and learn )

I was in a RTA as a passenger (named driver) it wasnt our fault, other driver admitted liabilty.

I am still having treatment!

As for Cogent LAW......KEEP AWAY!!!

I have to SUE FOR NEGILENCE!!!

They LIED TO THE COURTS, DELETE FILES !!! I knew nothing. They never kept me updated!!. I wrote to them several times a year, everytim I had treatment etc, and asked for updates - NO REPLIES. I made complaints to them - NO REPLIES. In the end I complained several times to OMBUDSMAN!! eventually got a reply.....no not truth!!

Was told a questionnaire was not submitted, Then went to COURT and FOUND OUT THE TRUTH!!!!!

SO NO COMP Judge tells me to sue for Negilience and Comp.

They should be able to delete files as measure are in place - but they were! - NOT just MINE - BUT other clients too!!!

Well, yeah. But I was referring more to the style of the posts (ie, not generally very bright) and the fact that they never return to discuss it further.

Deeks: When people have some downtime from normal activities, like during Public Holiday periods, they tend to catch-up on issues bothering them, or those unable to be researched/resolved due to ongoing pressures of typical day-to-day schedules.

As Ross' said, Google* tends to draw in a lot of the passing crowd, & if it helps somebody get something off their chest by venting their frustration within a few lines of text, then I hope they feel better for it.

Don't dismiss the casual "multi" just posting for the attention, though.

* Other World Wide Web search engines are available.

Actually, I was looking for others who ad problems with Cogent Law! I didnt realise it was an old thread!
And yes I am still having treatment and yes I still have a case going!

How would you feel if your solictor deleted your files, lied to the courts ( obviously you not knowing anything at all?) and 5 years after the event still in pain, disabled etc??

And to top it off your car insurancer wont pay to sue what what they call "their own solictor"

Which to me is a breach on contract and breach of duty of care!
I didnt emply Cogent Law my car insurer did

And NO I wasnt bored when I posted this or the other post

Hi,
I had an accident on the 26th October 2010 and I still haven't been compensated, been for 2 medical examinations and apparently my solicitor is still waiting for the consultant to get back to her. So **** off with cogent law. Not sure how I can complain. Can anyone help?
#28
Don't use Cogent law for conveyancing either. My sale has No chain, buyers mortgage arranged. Cogent have Dreadful communication, started 21st September 2015 still not exchanged. Now they claim that my mortgage company accept the roll number but do not know who I am? Strange the mortgage company took another mortgage payment 3 days ago!

My father passed away last July, we were advised by the funeral directors to us Cogent Law, they claim they were the best probate solicitors, I was obviously in a bad place at the time so I went with them, what a mistake that was. My father had intended to do a will, but we all thought he'd have more time, so the probate is now over 10 months in the process.

Cogent Law rarely return calls, don't respond to emails, misplace info they've been sent, take lately for example, I received a letter stating that the DWP has halted everything until they sort out overpaid benefits into my late father's bank account, I rang the handling solicitor & told him that back in October, I had sent the former handling solicitor of his firm, scanned letters (made into PDF), which consisted of the DWP asking for repayment of benefits. The new handling solicitor seemed oblivious to what I had sent, if I'd know that such a level of incompetence would of been forthcoming, I would of paid the overpayment of my late father's benefits myself, but at the time Cogent Law told me not to worry & they'd handle it.

I mean, really, what is the point of sending this firm anything, if they won't act upon it. Their website is down, I don't know who to complain to, inside or outside of Cogent Law, a complete lack of service which is going to cost me £2400, it's bloody disgusting.
