While our objective is to make your experience on eBay simple and enjoyable, our guidelines and policies are created to make sure that sellers understand which items are allowed on eBay. eBay prohibits the sale of certain items as the sale may infringe on third parties’ intellectual property rights.

The European Court of Justice has found that the sale of perfume testers and smell-a-like perfumes that are compared to a well known brand may infringe third party trademark rights. The sale of perfumes in bottles other than the original bottle (decanters) may also infringe third party trademark rights. Therefore eBay has decided to prevent the sale of such items on the European platforms and has updated our site policies accordingly.

The case was 4 years ago and they didn't find anything of the sort. Unless theres a case I don't know about, this case was against using comparison lists. Testers weren't even mentioned.

expired as this is complete bull. the way im reading that article it seems ebay is going to ban "smell-a-like" and "testers" aka fakes that are sold as smelling "like" another brand which infringe third party trademark rights.this has nothing to do with the testers we all buy, which come in white boxes and somtimes without the lid.

I can't even see an article arghhhh

Policy overview

Testers of perfumes and cosmetics that have only been given to shops for testing purposes but are not for sale may not be listed on eBay. Smell-a-like perfumes may not be listed on eBay when they are compared to a well known brand or scent. You may not list a perfume in a bottle other than the original bottle (Decanters).

See the What are the guidelines section for details about what you can and can't sell.

Make sure your listing follows these guidelines. If it doesn't, it may be removed, and you may be subject to a range of other actions, including restrictions of your buying and selling privileges and suspension of your account.
What are the guidelines?

Should not be expired: If you click the link in the "You can find the UK Policy here and the IE policy here" section it brings up the above post which clearly states

"Testers of perfumes and cosmetics that have only been given to shops for testing purposes but are not for sale may not be listed on eBay. "
