Mmm... on one hand its child porn, and obviously this is yet another complete **** up in a country famed for them....

but frankly sack him as well - he has no right whatsoever to go against the court and our legal system - lock him up, along with the paedo.

Personally, if I was in the policeman's position, I'd hand the material back, but only after doing something. Something like, ooh, I don't know. Making a fuss about it that garners nationwide press attention that reveals both the identity and the rough location of the kiddiefiddler in question, lets everyone in the country know what he looks like, and then sit back, and wait patiently for the lynch mob to execute justice.

Oh, hang on.

This is very dangerous ground and you are clearly too hung up on paedo hate (and I don't really blame you but still...), to see the bigger picture.

Lock them both up.

surely if the material hasn't been examined no one knows what the hell it is?
possibly this material is from cases he was involved in investigating himself, the article implies he was involved in work of that nature, many people reading and commenting despite the mass of missing details from this report..
As far as the policeman goes if he is so sure it is kiddie porn then he must have further evidence of the offenders activities and is simply looking for other factors to seal his case or he has already examined the material despite the court order and should really stand by his principles and say so.

I wonder if he/the police had already examined the HDDs before the court order banning them from doing so? It's the only reason I can think of which would make him take this stand.

If he is taking the stand based on suspicions only, then he is in the wrong to flout legal process.

Why doesn't he just wipe the HDD before giving it back? He's giving it back after all and Mr. Paedo loses his porn. Win win.

Apart from the fact that he could be charged with criminal damage, the problem with this particular 'stand' is neatly summed up by your post. You have just called the person in question Mr. Paedo without having any knowledge or evidence of the case in question.

the polioce officer must hand them back, if he gets away with this then it sets a dangerous precedent. Were would it stop?
the police just turning up raiding your house taking your belongings, locking you up for any reason they seee fit all because they suspect something is amiss.
