Here is the item I should have received (an M3 DS Real)

2/29/2008 02290ZTU Shipped and Completed via Tracked Air Mail RA858332578HK

I have been chasing this for more than 6 weeks. They keep coming back and saying "check your local post office" "please wait another week" etc etc. Here is just a selection of their most recent responses: Is there anyway out of this nightmare?

(in the weeks before this 'first' email below, we had already swapped at least 10 mails about the issue).

23/ 04 dear sir:

MY RESONSE: Yes, I have already contacted my local post office and even phoned the customer services head office, and they have no record of this item. And I have already told you this in previous communications about this item. Please action this issue - it has been ongoing for a long time now and you keep responding with the same ineffective replies. Please follow this up and come back to me when you have an answer rather than repeating things that I already know. Regards, --------

25/04 dear sir:
will you please wait for one more week?
if it is still absent we shall find you a solution then

MY RESONSE: 04/05 Ok, I've waited another week. It has not arrived. Please resolve. Thank you.

They now seem to have stopped reponding completely. As I say, this has been going on like this since March!

what a nightmare! If you paid with paypal you could make a claim or seen on here about credit cards helping to get your money back. Good luck.

I haven't had to deal with items that haven't been delivered, but I have done with faulty items, and found them to be faultless.

I can't think of what you can do apart from starting a Paypal dispute if you paid by Paypal.

Yes, my last response was to threaten the paypal dispute, but now I'm wondering is there a time limit on opening paypal disputes?

Yes, I'll give them one more day and then open a dispute if I'm eligible to under paypal rules. Aggggggghhhhhhh .... their responses are sooooooooooo frustrating!!!

I'm hoping it's 90 days, but read somewhere it is 30 days (hopefully wrong!). I better go check the paypal site.

I think there's a 45 day limit on opening a dispute with Paypal, I found this out when I tried to open one with Maplin a couple of months ago and was told it was too late and had to resolve it with their customer services instead who were an absolute nightmare to deal with!

I hope I'm wrong for your sake, Liddle!

13.3 Filing Deadlines. We will not grant any Claim unless you first initiate a Dispute in our Resolution Centre within 45 Days of the date of the relevant payment and then escalate the Dispute into a Claim within 20 Days of the date you file your Dispute. It is your responsibility to keep track of the deadlines under this section.

Oh well, lesson learned here too. Now I wait to see if they respond again. Do they just hope that you go away (which I'm seriously tempted to do as it's making me mad!)

To be honest, I've had very little problems with them. In this case you'd want to make a complaint and request a refund... they should give you a refund without much fuss.... unless it's an high value item

Correct me if I am wrong but shouldn't you be disputing with royal mail instead since it seems like they have sent the item hence them providing you the tracking number.

they havent provided the proof postage to make a claim with and when it comes to a company this size it is up to them to claim postage and refund buyer

It's Hong Kong Mail - a few weeks ago Dealextreme said they would follow up with them but haven't mentioned it since. I've tried Royal Mail here but they have no record of it at all.

Sorry to hear that mate! I've never had a problem with them before. Hope you can get your money back or get a replacement.

And just to update: DX have got back to me now and apologised for all the confusion/delays and agreed to send a replacement. Well done them. Despite this one unfortunate episode, I'll continue to use and recommend them. (Modifying the post heading now too.) :)

I am currently in a dispute with them where they will not answer my emails. They have change the track and trace number on me approximately 20 days after shipment without informing me. both of which have never be traced past a pick up i.e. never made it to the postie in hong kong. Any advice? What way did you contact them? It is now day 39 or 18 depending on what track and trace you use.
