Following pretty rough deal on here I have received a games console that died within 30 minutes of it being on.
its likely done to being shaken up when delivered I am assuming.
the seller offered full refund if I sent console back but then changed his mind stating he was not liable.
Additionally member has now been banned and is taking it badly.

I have basically been told that he will make a claim with DHL and refund me half the money one the console is back in his possession.
I am in two minds about what to do.

Opinions and thoughts welcome.

No - he claims against DHL for the cost of a replacement item. They pay up, he gets a new item (up to him where from) and sends it to you, at whic point you send back the original damaged / broken one. However, if DHL need to see the damaged item first, he needs to refund you (in full), you send the item back to him, he claims from dhl. What he claims from DHL may not be the same as he sold it to you for - depends on insurance limits.

He is unwilling to do this and is basically holding a grudge against me due to being banned.
He still has my money and I have nothing to show for it if I sent back the console back to him.

I really can not afford to be out of pocket this much on here.

He will give you half the money back? How kind of him. Has he stated why you are only getting half?

Then again, he may state that the goods were in working order when he delivered and it is not his fault. Although should DHL concide liability then he has no real reason to keep your money as they will compensate him the full amount, thus earning him 50% for nothing

May be an idea to go to your local CAB with a view to taking him to a small claims court. Or you accept that you have lost money and let it be a lesson learned.

Personally i wouldn't buy anything in a private sale on here.

Seller could have known it was broken, attempted a fix and got it working, then sold it as fast as possible to blame it on the delivery?

Like fixing xbox360 with xclamp so it works for a minute, then selling it to make it someone elses problem.

Yeah I am planning on just stating I am not willing to send back forst for 50%...his demands have become unreasonable.
Might check out CAB but i doubt there is much they can do though I do have a long paper trail of emails.

It worked for 30 minutes roughly then died. Have looked online for fixs but its doubtful and Sony will charge me for replacement if I am lucky.
Think its of to an auction site as selling for spares.

If nothing else at least we are one scammer down on the site

or maybe it worked and you were just unfortunate to use it and broke it - after all you state you used it for 30 minutes before it broke - he should put in a claim to DHL and get a replacement - he can then either give you the replacement or refund you what you paid and keep the replacement
