    I would point out, this OiNK Teeside bloke will be having a landmark case.


    As noone has been arrested for running a tracker within the UK before.

    Also he never exchanged copyrighted data and the site will have had warnings not to exchange/upload/trade etc copyrighted material.

    IMHO if he has a decent barrister, the entire case will be eventually thrown out/dismissed, this is a bad attempt by the BPI, to look good in front of the various Gov bodies and the lobby groups that pester the Gov for action in the run up for the commercial diety that is the Christmas Sales/4th quarter performance accounts, so that sales at at their optimum and is just making them look awfully greedy and negligent in the eye of the law and what it actually applies to.

    It feels awfully similar to Wednesdays Watchdog, ignorant Policemen believing their poor training on a laser speed gun and their guesstimation of speed is enough to convict someone of speeding and ignoring the fact that any authority, Police or BPI or similar must provide their evidence in a fair, just and ACCURATE manner and apply for prosecution as per the letter of the law, that is not the case with OiNK or other torrent tracker sites IMHO as, again, the sites themselves do not exchange copyrighted material.

    Personally I would like the BPI and similar taken to court for gross misrepresentation of the fact they persistently and continually assume every traded release to a single peer is counted as lost sale and added to the meaningless amount for whatever industry they are moaning is suffering because of this.

    As has been mentioned above, the majority of trading does not mean every item = one lost sale, and is a grotesque assumption to say so, it is mass production lieing and deception by claiming this.

    Broadband and data sharing is here to stay and the retailers, labels, studios and distributors are pissed that that we are not wasting our money on their overhyped overpriced products and increasing their lovely revenue streams keeping their board executives/management/shareholders happy.

    this is just stupid. Pirating music brought me to a lot better bands that deserve attention than the heavily advertised and mainstream bands on the radio. I have brought a lot more CD's because of them being on oink than before i downloaded music.

    I dont see myself as illegal either, unless its a physical copy.

There are a couple of multibillionaires called Larry Page and Sergey Brin -- the founders of Google -- who provide vast numbers of links to content that is being illegally distributed. Indeed, as everyone knows, they actually host plenty of illegal content on their own video site, YouTube, which has a UK operation.Is the message that it's less criminal to host illegal content on YouTube than it is to to link to it from a site such as TV Links? Or is it just that FACT (Federation Against Copyright Theft) and the police won't tackle anybody with enough high-powered lawyers to fight back? Is ]The New Freedom blog correct in saying: "They just have so much money that they have become above the law."




    Just shows what hypocrisy there is in law enforcement

    Torrent sites like oink merely provide a facility for people to connect to each other to exchange copyrighted material, significant difference imho and is why some swedish/dutch sites have not been taken down as decent lawyers can fight off any action.

    thing is, they calculate their losses wrong by thinking that everyone who downloads or listens would of bought the item, some times ive downloaded and deleted it straight away. If some of the creative industries were more creative as apposed to making the same old by the numbers cheese for money id be more inclined to respect that.

    i buy lots of dvds and cd's still, and that would not of been bought had i not downloaded first.

    I study music and having the resource is a life line, in contrast to my first government financed college where alot of people just turned up and treated it like a youth club, i studied hard (rumour was funding was 4000 approx per year a student) now that was criminal

    I agree. Unfortunately "upto" is the key part of this quote... I doubt he'd get 10 years.

    It'd be good if he did. NOT because I think he's in the wrong, far from it... Simply because I think it's the only way to start a national outcry about the state of the system as a whole.

    I think this is fair game.

    OiNK did pre-release media, took donations for it, and supplied the scumf*cks that make commercial enterprises out of piracy with their lifeblood. Up to 10 years (which gets cut in half, and then again, and again) seems quite fair considering the damage that his sort cause to society. He was a criminal. The law makes it clear what sort of penalties are on offer for people who do the sort of things that he got up to, and he had the choice to cut a living by a legitimate means. That he didn't and has now been done for it is what you get.

    To repeat, none of these sites hosted any copyrighted material, any decent barrister can minimise the sentence of any successful charges/convictions because of this.

    I'm all for home piracy for exactly the reason you describe. How many CDs have you got that still bear £12.99 stickers from Virgin Megastores on them? I've probably got a similar number. And how annoying is it to see that CDs now sell for £5 on CD-Wow? I mean, £8 now that CD-WOW have been sued for selling the CDs at a price that's profitable but, erm, something?

    It's for this reason that I don't buy CDs anymore. I've been clean for a little over a year now, although I've been trying to cut down for five years. Checking my Media Player library, I relapsed six times between 2002 and 2006. 2001 saw me indulge 23 times. Each of those purchases would have seen me over-spend by £7, roughly. As I own something in the order of 200 albums, I've been ripped off to the tune of around £1400. I pirate everything to get even, and think that's quite reasonable.


    But that's personal piracy. OiNK was commercial piracy. The guy was making a business out of selling other people's work, and that's wrong. Unless you live in Sweden, natch

    I was a big fan of tv links, loved the fact that i could watch shows like heroes etc that are televised now in the states but will take at least 9 months to start airing over here.

    If you can't afford something or don't want to pay extorianate prices for it, just don't buy it - don't try and justify stealing it.

    I would really like a nice big family car but I ca't afford one. And that's probably more of a "necessity" than entertainment items. I don't think stealing them is the solution (that'll teach those extortianate car showrooms a lesson).

    I just dont understand peoples attitudes to piracy. It's not anybody's "right" to have affordable entertainment.

    Prices of CD's have been coming down in the same way that all sorts of other items have been coming down - especially as markets/technologies mature, and as production gets shifted to sweatshops in the far east.

    I realise that I seem to be in a tiny minority on this issue ... it seems like copyright theft is almost taken for granted now. It's the battle of greed : manufacturer greed versus consumer greed ... who is the most guilty?

    Its not stealing, its copying.

    Its not the same as stealing a car, as you take the car and they dont have a car anymore.
    Pirate an album, they dont have a material loss. You havent went to their house and stolen a CD from them.

    Also, the majority of people who pirate, are pirating something they wouldnt have bought anyway.
    The industry dont lose out as the person wasnt going to buy it anyway.

    Also markets and technology in music, changed because of piracy.
    Legal downloads have killed the CD single.
    CD singles were £3/4, and people only wanted the 1 song.
    Buying it online costs £1 at most.
    Include manufacture etc say £2max total, and they would have still made a profit on CD's. So why charge double that for so many years and expect it to last.

    Was it on this site I heard a week or so ago there was someone who says that if you download a track it should be barred from being burnt to cd as she said cd burners encouraged piracy and if you wanted to burn to cd you had to buy it again.

    It wasnt till that long ago, that the music industry said they now allowed people to rip their CD's onto their mp3 players.
