ur a bunch of clever cloggs....what to do here?

we recently bought a used car from a dealers in london.... this is the website http://www.topgearcar.co.uk/18218/topgear.htm we bought a 53 plate CLK for 16grand and p/x our rx-8 for 6 grand.

we were told the clk had a full service history...he showed us the book thingy which was stamped by a mercedes dealerhip at the apporiate dates... however,... we checked up on this as there was no paperwork to go with the history..apart from the stamps... lo and behold...the mercedes dealership have no history of servicing the car! the car has done 66k miles..... so it is a bit worrying...

where do we stand and what can we do...who do u reckon faked the service?

When you click 'Warranty' it redirects to the AA website, is this just me ?

Not a good start buying a car off them and their warranty page doesnt work ;-)

Phone them firstly and explain your concerns, if that does not get anywhere (which I'm sure it won't) then you need to talk to the DVLA, trading standards and the Police explaining the situation of possible fraudulent paperwork.

Was it sold as being HPI clear? did it come supplied with a HPI cirtificate?

Anyone can fake the servicing and becuase you'll never be able to prove who it was I'm afraid there nothing you can do...... same as those people who buy cars and find out they are a cut and shut job etc etc etc they are the ones who loose out becuase the car gets impounded, no refund. you should have some kind of buy protection though if its from a legitimate garage, they should be your first point of call.

Hun you need to find out who deals with this (dont think its Trading Standards) and get it sorted quick time....if thats been faked you never know what else has...check if its been involved in anything eg accidents etc

If its a trader then you have the right to a refund, getting it may be a different matter, if you buy privately no you don't. Thats why some dodgy dealers also sell a few "privately".

Would definitely be interested to know if it has a full hpi check. Seems that all there cars have service history!? Is that just a coincidence? I hope you get it sorted, thats a lot of money you paid. My first point of call would be the garage and see what they say :thumbsup:

Unless you find a big fault with the car quickly, don't think they will refund you because of dodgy papers.

If you paid by credit card, you can try phoning them up and they can most likely help.

Maybe a long shot, but it could be that the Merc had a private plate on it. This could have been removed before you bought it. Maybe a call to the service centre again with the dates/make/model of the service would turn up a car with a different plate. With it being a CLK its not even a bog-standard merc, so more likely to show up.

Question.

Would you have bought the car if those stamps had not been in the book? (ie no service history.)

Did these stamps influence your purchase because it indicated the car had been looked after?

If it is true this dealership has falsely declared information regarding the car, you are entitled to a refund.

Have you spoken to trading standards? Dealers are governed by laws and i doubt they would want anything untoward about these goings on getting in the public eye. Definately challenge them on what you have found out. There may be a plausable explanation, but it doesnt look like its a good sign!

ie if you sell it on, would you admit it has a dodgy service history? These are all factors on the cars true value and it really sounds like you have been deliberately misled on purchase.

hey guys..thanks so much for advice.....

we were gonna go ring tradig standards so re rang merc garage again just to confirm car hadnt been serviced there (yeah its important cos hubby is a bit nuts about servicing cars!) and now they say that the HAS been serviced there ...just that the book hadnt been brought in each time and they decided to stamp it all in one go :? hmm dunno if its normal....sounds a bit dodgy tbh...but hubby is happy and i feel a bit :oops::oops: for making a big hoo ha here....

You're right for making a hoo-haa, I would as well if I thought the car had fake service stamps. Hopefully it is all ok though.

They should have checked on database first time as book is not how they hold records as it is yours. Assume dealer took book in to get stamped up just before it was sold - strange how they only changed their mind when Trading Standards was mentioned.

Are you certain that someone at the garage hasn't been caught out by falsely stamping book with no service actually being carried out? Presonally I would now ask for a print out from the garage that should match with service history in your schedule.

Glad things turned out ok. Just makes you wonder how many people check on the service history they get to see if it is legit. Tbh, i never have.:?

I would definitely lower the future resale value or the settlement figure in the event of an insurance claim if a full service history is not included, Might be worth asking if you can get a copy of the relevant documentation from the garage, Might be difficult obtaining though as it's not in your name.

In the event you were sold an item with missing documentation, i'd guess you'd have had a claim on the difference between the valuations of a car with full service history and one without, rather than a refund on the whole purchase.

u guys make sense that should look further into it...but tbh it was so stressful and husband was really worried about it...tbh i cant be dealing with the tension and stress.... pathetic i know..... but ignorance is bliss...

will get round to repping all... managed a few today :)

I would be asking myself, how many previous owners? did they live in same place ? do they take car to be serviced at the same garage ?
strange how you called first time and no record, then recall and oh it's here.
Is the garage far from the dealer who sold it to you ? suspect they got wind of it and have pulled a fast one with the garage(backhander), all very suss....

Check MOT certificates ? mileage recorded on these if any ? etc etc

the garage ( if decent) should be able to provide all details of service as all is now kept on computers , ask to see reports, but go to garage don't call them as they will be prepared...
