URGENT HELP NEEDED re council tax

I have a friend ( yes it really is a friend not me) who paid her council tax late, it was later for three occassions, lets say instead of paying it on the 4th she paid it on the 8th. Anyway she has not only had to pay it all ( which she has up until next year) they are wanting £95 court costs. She has never got a reminder or any letter at any time to say payment was late and when she rung the office this morning they said it was for Merton council admin not court costs. It was applying to the court. She asked why she should pay court costs when she never went. She is a pensioner and £95 is a huge sum for her. Any advice?

It is quite clear on their payment book what happens if you do not pay on time you get one chance and then after that have to pay it all.

However I would recommend your "friend" call the local office and explain the circumstances and they may be sympathetic.

Thats terrible, probably best to contact her local citizens advice or independant advice service. It certainly seems like extortionate admin cost !

We are trying to call the CAB but cannot get through, she has already rung the council office and they are totally unsympathetic and could care less. She has paid everything in her life and has never owed money to anyone. It seems to count for nothing, what about all the people that don't even pay???? thanks for your help will keep trying.

Yes, I missed one payment and they warned me if I was late again or missed a payment there would be no contact and they would send me a summons for courts demanding all the money be paid in full. Sadly they are within their rights to do this. They were less than sympathetic with my situation and proceeded via allocated debt collectors, or should I say inept debt collectors!
No wait *useless* debt collectors who despite all my contacts with them and even payments, decided to send the bailiffs to my house!
Bloomin cheek, I know alot of council workers who always say alot of the money goes to waste through red tape on various services they provide. It winds me up that they are allowed to be so inflexible with regards to payments of those on lower incomes etc.
Hope it gets worked out for your friend and she can resume reasonable repayments. They had no sympathy for me and I am now paying £240 a month back to them. GITS they are! :(

And they'll spend it cleaning up grafitti... Oh well...

Sadly I can only confrim what others have said, council need to be strict or people wouldn't bother paying...

I am so sorry to hear that it seems they are a law unto themselves. It just seems so unfair that so many other people don't even pay !!! thanks everyone I really apprcaite your input.

The council will win regardless, its gotta be paid unfortunately the penalties are quite clear, pay up quickly or end up owning more.

Its cruel way that the councils do business but thats the way they do it unfortunately! The bar stewards that they are!

The court cost fee will be added to her bill but only if the council have taken it to court and your friend must have received a letter to the effect that it was going to court. If she has had the letter and then brought her payments up to date then unfortunately she will be landed with the £95 court costs as the council will already have passed it to the courts so a fee will be made even if nobody turned up.

If on the other hand she had never been told that the matter was going to court and never received any written confirmation that it was indeed going to court and had a specified court date then as far as I'd be concerned she shouldnt be landed with the court fee as she was never formally informed with a specific date.

As other post have advised, for her own peace of mind, she should contact her local Citizens Advice Centre for further details. Hope this helps. Cheers.

They have become very strict regarding payments. I appreciate some people out there don't want to be bothered paying it, but some people like your friend and myself have genuine reasons for missed/late payments. I guess its hard for them to distinguish who is being genuine and those who are just making excuses cos they dont want to pay. They should still be more reasonable with repayments for those who can prove their situation is genuine, but sadly not.
