hi,

i recently sold my xbox to someone on ebay. the xbox had been repaired by microsoft and has a 3 year guarantee with it which i mentioned in the advert. i tested the console before i listed it and it was working fine.

the guy received it today and said that the cd tray dosent open unless you turn it upside down, then the game resets itself after ten mins.

he says he wants to send it back to me, and has opened a dispute with ebay, and they are holding the funds from me until its sorted!!

can anyone help me what to do. i really dont want to refund him unless i have to as i know the console was fine. i have a horrible feeling he may have broke it or changed his mind and hes trying to pull a fast one. thanks alot!

he is probably bluffing and tell ebay or him/her about the warrranty again. seems genuine as he wants to send it back rather than money back

or maybe it has been damaged in the post, that dont exactly handle goods with cotton gloves

I personally would ask them to return the item and then refund

Yeah was just gonna say the post argument lol. Seems a bit unfair if it was fine that you get your console back, banged up lol. Tell them they have a warranty and can send it off for repair or something? Or say you'll arrange the repair etc

yeah, ive told him about the warrenty, and i asked if he has contacted them. that is the whole point of the guarantee in the first place isnt it!? but he hasnt replied

problem is he purchased something that was supposed to be fine with a guarantee , they have now received an item not fine with a guarantee

I'd go with the damaged in Post route. Somehow Parcelforce managed to snap a back panel of a Mazda MX5 even though it was parceled up with bubblewrap and 3 layers of cardboard in a prism shape (the strongest of them all!)

robotochan, how would i go down that route of possible damage in transit. i sent the item recorded delivery. any suggestions? thanks

What was the exact delivery method? just Royal Mail 1st Class Recorded?

how much did you sell it for, and how much was it insured for via delivery?

my mistake it was actually special delivery it was sent that way cause of the value of the item. if he sends it back hes gonna ask me to refund the postage isnt he plus the cost of console? he bought it for 167 pound. the special delivery method insures for 500 for lost and damaged items.

if he returns the item then yes he will expect a return on postage costs too, if the item was damaged in transit then you need to fill in the appropriate froms with royal mail

bit stuck with this now cause its like how would they distinguish if it was their fault, and what does their damaged insurance exactly mean... that it covers the item broke inside box in pieces for example, but would they cover for the item not actually working? its a bit of a vicious circle isnt it! prob should contact them to confirm. worried bout this guy cause he had a negative feedback from someone saying hes a con man!

not sure what forms are needed but get onto the royal mail site and see what they say on there

You sent the xbox in working order - it doesn't mean it arrived in that condition. I'd ask if the packaging it arrived in had been damaged in any way? This might help you determine if any damage had been caused by post.

I'd get him to return the xbox in original packaging you sent it - if the xbox is broken and it has the same serial no. as the one you sent - I don't think you have any choice but to refund him the money he paid for the xbox and 2 lots of postage.

If you didn't make a note of the serial no - tell the buyer you did and that you'll only refund if its genuine...

Bear in mind it's not really a three year warranty if you're meaning the extension MS offered after the RROD problem - it only specifically covers that problem or any relating to it so problems with the cd tray for example wouldn't be covered.

It does sound like the buyer is taking you for a ride though unless it has had a very rough delivery although I'd expect damage to more obvious than not working after ten minutes.

Make sure it is the 360 you sent to him.

He might have broke his, bought yours & is trying to pull a fast one !

Does this mean he has opened a Paypal dispute ? Has your Paypal account been frozen ? If so you need to follow Paypal instructions to the letter. :-(

It's also a fairly common scam to substitute a broken item o part with the one that's been sent so be careful. Did you take serial numbers or use any sort of marker ?

Take things slowly and make sure you check everything out before progressing. :)

The 3 year guarentee only covers RROD [red ring of death]
Any other problems are only covered by a 1 year guarentee. from the date of manufacture. which is on the back on the console.

im thinking exactly that. i didnt take the serial numbers. i didnt even think to to be honest. ill know in future to thou! the only thing i can think to do is phone microsoft cause i still have their number and see if they can give me the serial number from when the repair was done, and see what i can do from there

I've had a similar story when selling a product. What I did was tell the buyer that they could get it sorted out under the warranty. I also said that if they wanted they could return it to me and I'd give them a full refund providing the serial number is the same as the one i posted. I didn't have a record of the serial number but told the seller that due to scammers on ebay I now keep a record of everything I post. Surprisingly I didn't hear back from them.

Its got to be worth a go.

Wow thanks for the top tip guys, I sold a sky box on ebay recently (1 week old) but didn't even think to record the serial number.

hes filed dispute against me now through pay pal, so unforunately ive got to go thru the long process of having them resolve it (great!) 20 days it takes. cant beleive he wasnt decent enough to reply to my emails.
theve froze my account so i cant buy anything and if i sell anything they take the money off me cause its minus 167 in paypal at mo for the money he paid! they said they holding onto till dispute resolved!
hoping pay pal goes in my favour. who knows. ive got feeling even if its not a scam that he dropped it or maybe his kid changed his mind.im gonna fight it all the way though! thanks for advise

If its SNAD that he's filed he HAS to return the item to you via a trackable delivery method, so what people tend to do is REFUSE delivery. Not that i'm suggesting you do that, but it is a viable option :lol:

Oh and either way you DON'T have to refund him for the return delivery.

You said this buyer had a negative on ebay and been called a conman ? Contact the seller and see if you can find out what happened. He might have just pulled the same trick before (if indeed it is bogus) in which case Paypal will have it on record and it may strengthen your case.

Don't communicate with him anymore and don't send him any refund or anything. Keep all emails. Follow Paypals instructions to the letter.

Try to get hold of that serial number. Make sure you have all the details of the sale and of course anything else which will stregthen your case like photos of the console working etc etc ;-)

If you're not sure about anything either ask Paypal direct or use the ebay community discussion board for paypal and ask for help there. Make sure you use a posting ID on ebay and not your sellers ID.

Don't use eBay/PP that much and not sure if it's relevant but isn't it his responsibilty to check condition on delivery, if he says nothing then opens it he's accepting the item as is ?

Maybe different for buying from shops but aren't eBay purchases classed as private sales and the law may be different ?

The other thing the OP has to look out for in this case (assuming they ARE willing to take delivery) is that they don't sign for a special delivery box full of old argos catalogues. In that situation, as soon as it shows online that 'something' has been delivered and signed for its G A M E O V E R as far as paypal are concerned, as they WILL refund the buyer:x Trouble is in that situation, you can never prove what you actually received:-(
