Virgin media liars... where do i stand

Last tuesday (18th)i went into the virgin media store in merry hill shopping centre dudley, to ask how much it would cost me to add the XL TV Package to my exsisting broadband deal i have with virgin(been a customer for nearly 4 years) spoke to a nice guy who said he would enquire rang someone up and they said it would cost me £32.50 a month for my broadband( i now pay 17.50 a month) and tv package.

i thought that was a good deal so accepted it and arranged for it to be installed this coming friday(28tth). Yesterday i had to ring virgin to ask about something else, and while i was speaking to them i thought i'd just double check to see if my account had the tv package on and the cost, the guy on the other end said it was showing up as £42.50 a month, So i was like that is not right etc etc he said he could not do anything as customer services was closed so to ring back tommorrow...

So this evening i've rang the merry hill store and spoke to the guy that served me and told him what had happened so he said it would look into it, anyway long story short is he rang back saying that the original guy had mis-quoted me(32.50) and i could not have it for that price and it would now cost me £42.50...... So as you can imagine i'm not very happy..... cause (a) they quoted me a price i accepted arranged for it to be installed then low and behold alter the price, now if it wasnt for me ringing up last night and asking i would have been none the wiser until my first bill had been payed for and been stuck into a 12 month contract.

Also i have had to rearange my flat and have wall mounted my telly (£40 for bracket) for the virgin box i was suppose to be having that now is not coming...

Is there anything that can be done? I know some responses might be cancel etc but also spoke to a guy at retentions and he was a complete arse he said well just drop your package to L but why should i... The offer was made on the 18th and i accepted etc, and we can not have a phone line as tried before and it did not work...

Just really peed off about it was looking forward to world cup hd, and to be honest don't fancy sky so after all this will end up with nothing... Rant Over :)

So what your saying is they could have quoted me the first price........ and when i came to pay my first bill they could have charged me what they wanted...
If i had not of found out (by accident) thats what would of happened..If thats the case they could just tell people any prices they sign up then hike the price up

Hang on, so they say that their guy said you could have it for £32.50, but they now say it was a mistake? On that basis, I would offer them three options:

1) They honour their original price#

2) They nullify the contract, and you will pay them a token fee to cover the duration of the service you received

2) They, as per their legal obligations under the Data Protection Act, provide you with all data relating to your account with them, including the recording of the phonecall in which they admitted making the "misquote" and everything relating to your £32.50/mo agreement with them, and you will take legal action against them in Small Claims court.

I'd have serious words with the store manager, and preferably in full view and within easy earshot of other customers, too.

had you spoken on the phone to their sales centre call would have been logged and recorded, so the price spoken would have more weight

but you spoke to a guy in-store, who obviously knows nothing and says anything to customers
I dont bother speaking to various idiots myself and prefer reading the webpage, this kind of tripe service is what killed dixons

at least you refused the contract, so you are not paying the money, I think the lesson is, read the webpage, dont talk to the untrained idiots
it will be a waste of time in reality, to write a letter of complaint, and about the salesman, you will just get the basic sorry for nothing letter and wont get anything in return

so when you went in store, did the sales person write anything down for you or was it a verbal agreement?

no proof of original deal so only option is pay up or cancel

Really? Although it is fine due to being spoken, if the contract was entered into upon those terms with consideration then those words create the contract. Thus if the price changes considerably that breaks the contract as it is not what the two parties agreed on. Furthermore, it seems the guy who gave you the price at the hill store (or whatever) will agree this is the case, and thus you have some proof as well.

I'd complain to VM and say you either want it at the agreed price, as entered into at the time of contract or to cancel the service.

Try Which? Legal helpline (May have a free try-it offer, otherwise a tenner for three months). You had a (verbal) contract and relied on what the salesman said, so it may be possible to argue a case.

Wow.... Virgin Media lying.

Whoever would have thought it possible!

I would rather go without Telephone and TV if this company were the only option.

To all the above thank you for all the replies.... To be fair the guy in the shop is a nice guy it was not him that offered the deal it was someone who he rang at virgin retail and has even got there name so it must be on a order somewhere!
I haven't payed for any service's yet as it was to be installed friday, even the guy from the shop told me yesterday it's out of order and it's not the first time it's happened.
Just think this is gonna go nowwhere as Virgin are that big they can do what they want, well so it seems.

No they are not, especially if the guy in the shop can verify the truth in your story. Thus you can tell Virgin you entered into contract on the terms of £32.50pm and thus the contract is voidable, so they either stick to the price agreed, or the contract is dismissed.

I'd insist in this also.

Watch your credit rating though. This company likes to mess you around by applying non existant debts to your personal details as a going away present. (Been there, done that.)

Please OP don't feel bullied by big companies, they need us customers to make a living, yes one person doesnt make a huge difference, but too many people and it does. Also bad press for them as well, especially as VM have a bad rep already.
#15
let us know how you get on mate.

Well who do i need to tell this to the guy in the shop knows that was the price quoted but would he back me up and go against his employers thats another question...

It's just knowing who to speak to next and someone who works in uk.

I have just e-mailed a complaint to them so will see what happens now but no not willing to give up, and will let you know,

Just go in there and stand your ground firmly but politely, you need to go back into the store really.

The thing is that they are been fine well over the phone and it was not them that sold me the package it was VM RETAIL via Phone

I dont like virgin media, i emailed them before, and three days later they called up. My mum told them to go away!. I have a wire, thats been in front of my bedroom door, they installed it 5 years ago, the lead is still there, right in the place where i walk, my bedroom is right above the stairs!. there is a mark on the carpet where the lead runs, i think they are stupid, i knew i should have pretended to fall down the stairs as they dont give a damn, my mum now hides any virgin media leaflets that arrive through the door, they bug and bug till in the end u cant be bothered fighting anymore!. Hope u get your prob solved :)

huh?
you emailed them complaining (presumably), then when they rang to fix the problem your mum told them to go away? Hardly their fault.
