Hello, I am planning on writing off to Watchdog with regard these companies sending us unsealed, preowned/scratched games/dvds/cds when we have bought them as new.

I recently had this problem off HMV, one game came sealed in a Sainsburys storage bag, the other was badly scratched and had the rings around it where the 360 had scratched it. HMV didnt bother to reply to my email but they have responded to other people and blatantly lied.

One person asked why they are selling unsealed games and they gave some bumpf about the manufacturing process sometimes missing the seal off, absolute lies, they are clearly buying used/shop soiled stock from somewhere in bulk and passing it off as new. I have had games from HMV with Zavvi stickers on them as well

Gamestation have been doing it aand getting away with it for years, putting used/returned stock out as new and conning us. Game are just as bad.

Anyway I want to write to Watchdog to get them to investigate the legality of this practice and it would be good if I could put thre names of a few of us who are discgruntled by this along with any correspondance/excuses we have received. I will be writing to these companies beforehand just to get their final word on the matter and if you can suggest any other companies which are doing it I can add them to the list

Hmmm, my copy of Grid came from HMV and that was not sealed and had marks on the case.

Where do I stand with this?

Im not sure I will have to look into the legal side more closely if there is enough interest, is the disc marked in any way?

It's worth follwoing up as I do believe if a retailer is selling exchanged or previously owned goods they have to clearly state this at the time of purchase, the certainly are not allowed to sell used/exchanged goods as new.

some retailers like hmv do remove all the games for security reasons, sometimes they can get damaged by stocktakes and the like when new/temporary staff get a hold of them

could be genuinely mixed up with some of the trade ins though also......not really a matter for watchdof i shouldnt of thought, just take it back with your valid receipt and they will exchange for the same product no problemo

also it makes no odds to the likes of hmv who will get refunded by the supplier for faulty items regardless

I think you are missing the point, these are online purchases which regularly come to us damaged or preowned, Gamestation and Game do it instore and it cannot be legal, I should not have to repeatedly waste my time buying envelopes and queueing in post offices because these places have tried to palm me off with damaged/soiled stock.

Over christmas a lot of games were placed in sealed bags within the boxes, so you could return them if unwanted etc.

Bet watchdog ignore you, this is such a minor issue affecting a small number of people (most of which just did the normal thing and swapped it)

So the 'normal' thing is to let them continually take the p**** and waste my own time returning them is it ?

I believe this affects a lot more people than you might think except only a small percentage of us are actually pedantic/petty/indignant/righteous enough to actually do something about it. The longer it goes the more they will take the michael

I've never had what you've experienced, and you are right, you are being pedantic/petty/indignant/righteous, which is why Watchdog will ignore you. But good luck with it.

You cant honestly expect these websites to inspect every disk they send out.

if you dont like the service .....go elsewhere!!

more the fool you for carrying on ordering from retailers who are "conning" you

why not go into a store and see what you are buying if you arent happy with the process of buying online

Im afraid not flower, and there is nothing wortless, unsubstantiated or nonsensical about what I have written, I have recieved used games sealed in bags from other companies, what part of thaat dont you grasp ?

Rather than getting other peoples details ask people to make the complaints at the same time as you so they receive them at the same time. giving other proples names would be like a petition and they would need these peoples permission to contact them not just your say so. good luck never had a problem with any of the retailers you mention

Thanks but I think Ill just leave it, I just hope theres a great big queue in the post office next time some of the half bakes that have posted in here have to send back their damaged goods :)

i really find it hard to believe hmv based in a massive warehouse in guernseyjersey is sending you used games from sainsburys....:whistling:

agreed - some of you just missing the point.

re inspection : why on earth would it need to be 'inspected'?
its a new product - you folk in warehouses dont break the shrink wrap then open the case to check there are no marks on the disk. its a fair assumption that a new shrinkwrapped product should be perfect.

re exchanges: if i order something i dont expect to have to repeatedly deal with and accept for their incompetence. what if the replacement was also damaged?.. oh just get it replaced!
its not petty etc to expect some decent service and respect.

re unsubstantiated: insomniacs not the only one if you bother to read around or check other forums about this sort of thing - but then ofc if you haven't come across a problem then its unimportant and doesn't exist.

Ok well in that case what exactly would you suggest the solution to the problem is other than every disk being checked before it is sent?

Also with regards to your original post:

- Not all CDs/DVDs/Games are sealed during the manufacturing process.

- You ASSUME that the marks on the disks are caused by the xbox360 marking them, do you have any proof that this cant occur during the manufacturing process.

- you say some disks appear to have been removed from their case and damaged at some point, this may have occured whilst the product was with another retailer. Pretty much all retailers use the same wholesalers and buy on sale or return, so they send back what they dont sell but it may have been on display instore, hence why the insides have been taken out and may have been damaged at this point,

- you say that they sell returned stock as new, any store does, if you return a shirt to Next they put it back on a hanger and out onto the shelf, they dont sell them from a 'returned section'

I am not just trying to argue with you, i just feel that you should appreciate the difficulties that occur when sourcing and selling thousands of disks everyday and that it is not necciserily intentional on their part that these problems occur,

Ok so if you expect every disk to be checked how do you suggest that they do this without annoying the OP who complains if the cases arent factory sealed?

Further to this checking each disk would add additional labour costs pushing up the price of the products, not something HUKD members would like

Nice attitude.

I know Game used to sell games that had been returned under their 10-day policy but they don't do that anymore.

Never had the problem the OP is talking about before, and always try to get a sealed copy if I don't buy online.

Maybe he's unlucky, or rubbed some shops up the wrong way.:thumbsup:

No, all im saying is that a product sold as new should not be in used condition.

So if indeed they were taking the disks out (wtf),
YES I bloody well would want them to check them before they sent them out.
