Were Do I Stand???

I bought somthing from here from a very trusted member but the item hasnt turned up and it's been 2 weeks

the guy has filled in and sent a postoffice calim form but the item wasnt sent recorded

so he said i can't get my money back untill the post office give him the money back which he said will be 15 days

i dont think its right i should have to wait as i have already waited 2 weeks for the item to arrive

and i just wanted to know were i stand do i have to wait for the money or should the guy be refunding me now??

any advice will help

why not ask him for a copy of receipt from post office ? if it wasnt recorded

if he does - give him a bit more time

i have just received an item (ebay) which took 2 weeks - maybe holiday time post office

Since you didn't pay the extra for recorded, or any form of insured delivery, then you will have to wait it out.
The seller is under no obligation to refund you before he/she receives a refund, unless this was agreed to beforehand.

There is no 'obligation' to do anything - it relies on trust. There are no contracts.

Personally, I agree with Keith - its on the seller to make deals work, so you should get the refund immediately, and they work it out with the post office as they wish.

However, it doesn't seem to work like that here - and its wrong in my view.

recorded delivery wasnt offered to me or i would of happily of paid the extra

but i suppose ur right i just have to wait but it pretty much sucks i have to wait 4 weeks just to get my money back :x

if he's gone to the claim department, he's clearly doing whatever he can, i've sold a few things on play/amazon and a batch of dvd's, about 200 quids worth went 'missing' turned out it was just sitting in the post office for 4 weeks, it happens, and all you can do is communicate with each other (buyer/seller) and hope for the best, it will get there, but royal mail will basically only shift when they get a claim request through....

I suppose it depends on the seller, recently happened to me, but I hate owing so I refunded after 2 weeks of not arriving, THEN done the claim. That way buyer is happy and you can nag Royal Mail.

a similar thing happened to me last week but I'd bought something from Evans cycles. They posted it first class recorded delivery but it never turned up. when I contacted them they said they would refund me or send out another item but I'd have to wait 15 days as thats only when they can claim the royal mail for the cost of the item back. If the person is a trusted member then I dont see why they wont return your money when the royal mail 15 day period is up.
I'd contact your local royal mail distribution office.
I contacted mine and they took my details (name ,address, and sellers contact, EvansCycles) and searched for the item that was missing. That was on Tuesday last week. Got a call on Tuesday this week to say they had found the item and that Evans cycles had not put my house number on the parcel. Worth a try

I'm not suggesting the seller isn't doing all he can - but in my mind at least, the buyer should not have to wait for the refund.

He bought an item, which wasn't delivered - not the fault of the seller perhaps, but the seller should be the one 'down' until the royal mail refund.

It's very unlike him - he might be dead or seriously ill.

But hey - make sure you get that refund :-D

I refunded someone on here when the item didnt turn up after about 2 weeks. Put in a claim and didnt get jack back from them so now im out of pocket. But the buyer is happy!

I feel for you, I do - but thats EXACTLY how it should be in my opinion. Seller should keep buyer happy. Seller needs to cover costs when it goes wrong.

I buy and sell, on here and ebay, and if I lose out, I lose out.

No, i'm glad the seller is happy otherwise it may ruin your rep on here with regards to buy/sell. Just annoyed at royal fail!

(13) Goods remain the responsibility of the seller until the buyer takes possession and affirms they are okay. For this reason be honest in your descriptions and include original photos so the buyer knows what they are getting! Also, use a form of insured and signed for delivery to ensure any shipping/delivery mishaps will be covered.

i sold 2 items on here not long ago and both parcels got lost in the post and i had to refund both people couldnt even claim either as my mum posted them and didnt keep the tracking numbers its really annoying at times with royal mail i have been waiting 3 weeks for a order off figleaves looks like that has been lost in the post as well and my holiday tickets were dispached from thomas cook last friday and i havent had them yet either.

If i was the seller i would refund now and try to claim back for myself,Not sending recorded is the sellers mistake as if he has no proof of delivery then he should be the one to lose out,

LLM... It's nothing personal OK, but I think you are completely wrong.

As Antz said... the most important part of any transaction is that the onus is on the SELLER to complete or refund.

If you don't want to work like that, in my opinion you shouldn't be selling. I don't wanna lose money, same as you, but refunding the buyer is most important, then you deal with the royal mail yourself. I've had to do it in the past (ebay not here) and its a pain in the ****, but it HAS to be done. You say you are being helpful, and I'm sure you are - genuinely I am, but you seem to be missing a fairly fundamental point. The buyer paid you money and has got nothing. You NEED to refund that, and then sort out your own refund from RM.

Hope you reconsider.

The buyer doesn't have another 15 days to wait also, he has 15 working days from the date of postage. That takes it until the 22nd May.

Dude.... dates are immaterial. buyer comes first... always. Even if you hate the guy... sort out his issues, make sure he's all square, then unlease the fury with RM.

I don't hate the guy, far from it. I will compromise and refund half the money now and half the money when i myself am refunded. I ain't being any fairer that that at the moment. I am off out, please let me know what you wish to do Viperkeith.
And as proven by my Pm's, on this thread, and continualy updating you, i have nothing to hide and feel that you should understand that.

Fair enough - but again, not being funny either, I don't think anyone has agreed with your 'style' of selling (in this thread)...

Maybe in future you should point out you work to a different set of standards, and people will have to wait for you to be refunded etc.

All I say say is I promise you, the way you deal with things is not the norm.

incidentally to the op how did you pay if it was by paypal thyen I'd open a dispute straight away and fortunately they won't hang about to be refunded by royal mail.

llm this is a poor show and if this was just a random nondescript seller then they'd have been hung drawn and quartered by the misc crew by now for this attitude. Do the right thing, refund the guy chase the royal mail and learn from this.

And i agree with ants had it been someone else the reposes here to you would have been far worse than what they are, the onus is on the seller to get the items to the buyer, and if this doesnt happen they should be refunded, not have to wait to see if you can claim back off RM

Also to the op, the said thread should always be kept updated, so everything is in the open, pm's should only be used for private details, names, addresses, payment, etc,etc

You shouldn't have to wait, and the rules suggest you should be refunded immediately. However, it appears you will be waiting anyway :(

I will give you a refund, i ain't a hostile person and am really upset with this, i am genuinly sorry this has happened, im sure you understand that after showing you the proof of postage and kept in contact with you that i'd done my part. Wow i'm getting upset over 16 quid, i really need to sort myself out, Please send me email address, and i will wait for my refund from royal mail.
