i sold an item for £180 + Delivery

the item got broke so i emailed the guy asking if he wanted me to refund the money sdtraight back to him to that paypal address

he threghtened he was coming to my area next week and to "fu*cking refund it or i will take your legs off"

so i email him back saying ill refund now stop being an ar*e dont you think im pissed of as i just lost 180£ ???

ill refund your money now

by now the **** has already opened a paypal claim against me!!!!!!!!

so i click on it leave a message saying!

item got broke asked if he wanted refund and to email me so i know i had correct email address. he threghtened to "take my legs off" and am refuning the money now 20:19 30/3/07

i then refunded him the money, it went form my account.

this morning:
i get another email reminding me to refund the money or he will "remove my legs!"
i emailed him back saying if you want me to refund the money AGAIN then you needed not to have open a paypal dispute coz now you have to wait for them to sort it out as i have already selected to refund you the ££££ in paypal!!!""

now paypal are saying i need to transfer him £180 off my bank card!!

and the cash in my paypal account isnt there!!

Hi mate,

Call Paypal on the number from their website clearly explaining what happened, then see what they say and let us know but they should be able to pick up on the technical error.

Hope that helps and i'm sorry to hear your sold item broke, i really do hate it when that happens when you sell a perfectly working item and then they break it shortly but you don't even know if it's been misused or if it's a genuine claim, you just have to admit defeat and lose all the money.

EDIT: Here's the national geographic number in order to keep the cost of the call down or free if you have virgin media etc phone service: 020 8605 3000, hope that helps mate and good luck.

Surely if the money went from your account then you can provide PayPal with proof of this - PayPal will then close the dispute.
#3
I can't believe your buyer. What a complete to$$er.

First, I know how mad you must be, but you need to calm down.
Let's start at the top, your buyer started a Paypal dispute against you? You clicked on the 'refund' button relating to this transaction? Did you have all the money in your Paypal account to refund him in full, including P&P? Did you receive an email from Paypal confirming a full refund?

I dont quite know what to say, im not even going to try and advise.

I just wanted to say, dont put up with his idle threats, if he continues - id contact the police as thats really not on.

Have you had the item back? How do you know it is broken? If you posted an item worth 180 quid did you send it special delivery or just first class.

If you sent it first class you are mad, if you sent it recorded you are daft. Special delivery covers you up to 500 quid for damage in transit. However you have to make the claim and need the packaging and the item back.

It's too late now but this guy sounds like a right thug, however I would have done this.

Apologised to the seller, explained that damage occurs in transit and that he should return the item and the packaging to you immediately. Explain again that any seller no matter who they are asks buyers to return goods for refund and that you will handle this as quickly as you can.

It makes no difference that he reported you to paypal, they would have told you the same thing. He MUST return the goods.

I'm sorry you are out of pocket but this is an expensive lesson, always send anything with a value SPECIAL DELIVERY and NEVER return money until you get the item back.

If he sent you this abuse through ebay report them. On the bottom right of every ASQ you will see this:-
Is this email inappropriate? Does it violate eBay policy? Help protect the Community by reporting it.

I think the seller found out that the item broke before he posted?
#9
Keep all emails you send and receive regarding this situation!

Hope you get it sorted......

You could always get a HUKD gang round their house. You have their address! :w00t:

Sorry I read that wrongly.

How could the Mobile have got damaged in the mail? S/D is the most secure and safest postal service available. I use it every week.
Your buyer is a PS, not that it means a great deal but he should know better.
Something ain't right here.
#13
Make sure you keep all emails that he has sent you, as he is threatening you. I would inform the police in case he turns up on your doorstep.
As said above, surely it was covered by the insurance for breakages in the post.
#14
I don't think it was posted, was it?
#15
no my brother dropped it while packaging its all scratched not broke but not very good and cant see screen!! as the liquid has ran !

i phoned paypal and they said was there error i have also forwarded the emails to them and as sending them to the police!

To be honest it's a lot easier to negative rep you than it would be to remove your legs, plus it's very messy too.

Take the neg rep and give him negative citing a threatening manner.

(he's probably 15 years old and 4'7")
#17
lol

well ill wait till last day i can leave rep and then neg him for threatening behaviour!!

lol
#18
He's already negged you:-
http://pics.ebaystatic.com/aw/pics/uk/icon/iconNeg_16x16.gifOH What Joy, pay instantly then says items is broke then will not refund, AVOID

You handled this wrong from the start. You should have refunded him straight away, that way he could not have started a dispute.

It's an LG Shine, already in a box. It must have fallen from some height onto concrete to get that damaged. :giggle: :giggle: :giggle: :giggle: :whistling:

YER i was gonna but advised to to!

What?
You have this guys money and nothing to send him. Refunding him should have been the first thing you did.
#22
no coz when i spoke to paypal about refunding they said check his email address first!!

and he was looking at the phone not in box and it was gravel!!!
#23
sorry mate, i forgot to say i got the number through www.saynoto0870.com which i use all the time to save money on expensive calls to 0845 etc.

Make sure you leave a comment on your own feedback where he gave you a neg rep just explaining the phone broke but you refunded him straight away despite his physical threats and bad manners and also send him neg feedback on his behaviour.

I'm glad it's all resolved and make sure you get the phone back as well, as paypal previously told me that they have to send it back with a tracking number, then you should refund them, so send him an email saying it's necessary to be sent back with either recorded delivery or special delivery, otherwise it's considered theft and the police will be called into action.

At least you'll get your phone back and you'll know if it was really the case, as some people cost me a lot of money by opening the package (which you can't seal again, meaning it can no longer be sold) and decided they didn't want the item anymore but just used the excuse of being damaged.

hope that helps and keep us informed of what happens. :)

I never pack my items outside. :giggle: :giggle:
Nuff said on this.

Why would Paypal say "check his email address first". He'd only just paid you. All you had to do was click on 'refund'.

I've heard some waffle, but you take the biscuit. :x :x :x

all very odd

Jeez, it's like getting told off by a teacher in here sometimes...no offense dino, you offer amazing help to a lot of people, but you come across as a real 'head master' a lot of the time ;)

Antj87, definitely report this person to eBay for their threatening behaviour, no matter what was going on there's no need to be telling you he's going to 'Remove your legs' - reply to his negative and leave him a negative, but do it calmly and with facts...and check your spelling first, if you just post 'dis guy is a nonce, bloody twit' it makes you look worse, not him.

Glad it all got sorted in the end, though £180 out of pocket...ouch.

Only kidding....i agree with you Starlet, but if people aren't firm with whoever, they may make the same mistake.

like you Starlet Dino is from Yorkshire...he speaks his mind so there's no confusion...like it or lump it at least you know how he feels...that's the way I like it myself...lived in Yorkshire for 11 years and loved it...and loved the people cos there was no bull***t.

It was not my intention to come across like that. I replied with the correct information based on the information provided. I don't see the point in 'pussy footing around', I say what I mean and mean what I say.

It was not Paypals fault, people are always quick to blame Paypal.

i emailed the guy asking if he wanted me to refund the money sdtraight back to him to that paypal address

Why not just refund him and then explain to him why?

In post #13 I said this:-

How could the Mobile have got damaged in the mail? S/D is the most secure and safest postal service available. I use it every week.
Your buyer is a PS, not that it means a great deal but he should know better.
Something ain't right here.

I was right, something was not right, the item had not even been posted. The OP never said that, I had to dig into his ebay account to find this out. Why not mention it, it was a rather important point, don't you think?

OP's post #23:-
and he was looking at the phone not in box and it was gravel!!!

and then this post #30:-
yer well he was looking at it outside!!! when i was onway to post office to post!

This reply is not intended as a 'dig' at the OP, but for me to try and explain why I was, maybe a bit 'blunt'.
There is no point in 'hiding' vital information, if you do that I cannot offer the correct advice. Giving the wrong advice could cost someone a great deal of money.

As I said before, the buyer was well out of order and the OP should report him to ebay if the messages came via ebay, to the sellers IP and or to the Police.

Soz again for 'bumping' this up.

Thats one thing iv learned about Dino and his advise on Paypal and Ebay....

If someone asks for help or advice for each of these 2 companys, if Dino gets involved stay away from writing anything on the thread as it usually.... or sometimes interfers with his valuable advice :p
Maybe your comments are going to be very helpfull but take it from me just watch what happens and see how he deals with it
