Personally id keep it or sell it, and if they ever ask for it back pay the price and buy one to send them back.
#2
Keep it! It's their mistake not yours
#3
keep it. No more need to be said unless they contact u! Don't feel guilty, nintendo have plenty of money!
#4
id keep it in box for a couple of weeks.if you dont here anything keep it. xmas coming soon!!

I would contact Nintendo and inform them of the error and if they do nothing about it then keep it, that way you know you have tried to sort it out.

I am afraid to say I would keep it too.

Think of it as a goodwiil gesture for having to send the other one back!!

You are permitted to keep any unsolicited items that come through your door unless they are addressed to someone else.

moto of the story, take the persons name label off!

Id keep it, somethings obviosuly been mixed up but they may not even find out! Sell it on ebay and if they ask you a few months on, deny all knowledge

Dont think thats true of things you have to sign for. things thru the letterbox maybe.

edit, actually thinks theres some sort of 90 day rule, used to work for a parcel company, keep it for 3 months then its yours if not claimed, not 100% sure this rule still exists

I agree, keep it and do what you want with it. If Nintendo realise their mistake (which I doubt they would) and contact you, then just pay for it.
#12
Keep it. only a mong would give it back. If it were mr independant down the street i would tell them they made a mistake but things like this are written into the nintendo budgets for admin errors

I would keep it :)

I had a similar situation a few years ago with nappies and I contacted the company and informed them of their mistake (they sent double my order) and they said they would pick them up. They never did. I called Citizens advice and they told me from a legal perspective as long as you contact the company and ask them to collect it (don't agree to send it back to them they must collect it) and they haven't within a certain timescale (you'd have to check what this is now cos I can't remember) then it is legally yours to do as you like with. Chances are Nintendo being such a big organisation will not bother with the aggro of arranging a courier to collect :-D

Or you could just keep quiet and see what happens - again they'll probably just write it off anyway :whistling:

You went to citizens advice to see if you could keep some nappies  honesty gone mad :p

To OP I would hold onto to for 3 months and see if they get in contact with you.

thanks for all your replies everybody, think i will keep hold of it for nxt 90 days then if i havent heard anything i will sell it:thumbsup:

I would contact Nintendo asap and inform them of their mistake, offer to buy bubble wrap and protective box, contact a Courier service and arrange a pick up and offer to pay for all the expense to send it back!

Yeah Right!

Keep it for 3 months, if you dont hear anything, put it or your old one on ebay!

keep it I had similar thing with an old style Ds we ordered from littlewoods using codes to get it cheap because my son wanted the tribal version but it was on a delay and would not arrive in time for his birthday so we canceled the order and got a plain silver one from somewhere else. then a couple of weeks after his birthday the neighbour handed me a parcel that had been delivered while i was out. It was the ds we kept it and it never showed up on our statements. ( our son wasn't to happy when his younger sister got a tribal ds for christmas:giggle:)

I think it`s terrible that you all think the OP should keep it, how dishonest, I think you should send it back immediately!
I will pm you my address, err sorry,I mean their address! :whistling:

Complain (furiously) about what they did and they will send you another one in mis-understanding.
Happened to me in past with another retailer, name starts with car and ends in house.

Phone them and tell them it arrived broken and can they send another one.

Keep it and see what happens.
