I know if we have it on a fence we have to have a sign up warning about it, how big does this sign have to be (or more to the point how small can we get away with?)

Or if we dont have it on the fence but just inside the perimiter do I actually need a sign?

We have a dispute with one of the neighbours and have been getting stuff thrown over, including about a dozen eggs in the last few days, now the fence is currently about 8 ft high from the back road where they are obviously climbing up, Ive got some anti climb paint on order and am looking for a legal way of causing maximum deterrent.

TBH I dont really care if it causes injury so long as I keep within the law.

I think that even if they trespass on your land if something hurts them they can sue you and even possibly have you arrested?

Hope someone else can clarify this for you.

Also if they are throwing stuff over TAPE IT and take it to the police. Let them do them for criminal damage, harrassment etc. xx

Make sure you have evidence and back up that evidence in case it gets misplaced by whoever. I think you need about three pieces of evidence, witness statements etc xx

Protecting against Trespassers

Traditionally owners have put deterrents to trespassers on their wall or fence and if it is a party wall just on their side. You will often have seen spikes or broken glass or barbed wire on the top of walls.

However, if the wall/fence borders the public highway, then the local authority has powers to protect the public by having the deterrent removed if it thinks it could cause a danger to highway users. If the deterrents causes a nuisance or by your negligence injures a passer by, then they may be able to sue you. Err on the side of caution because if the deterrent is considered to be excessive you could open yourself up to a criminal prosecution for an injury caused.

If they are throwing things over the fence how would putting razor wire on the top help?

Well I'm guessing they are doing this at night? If so put a cane at each end of the wall and and put clear pallet wrap between the two, you could use cling film. (think of the cling film on the toilet idea) Then when they throw the eggs they will be in for a shock!

Well the mentioned road is a private unadopted one so not a public highway, and we also have chickens so this fencing/wire could be classed as protection from foxes.

Sadly without a camera costing hundreds taping would be impossible as its too dark, the road at the back is pitch black and unlit due to being private access to the terraced houses behind us.

They are using the fence to climb up as you can see where they have pulled on it. Its 8 foot from the other side and where the eggs have landed there is no way they could have thrown over.

yup can remember this from criminal law...something about your property should be made reasonable safe for anyone who enters it....be that legally or otherwise....as for the razorwire question...I thought it had to be a certain height above the ground (fence height) not sure of it though....I would go and ask at the police station...dont mention you want to make it dangerous for people but something along the lines of you think the razorwire would make your land safer for your family or something? (not sure you could explain a fox jumping an 8ft fence lol)

You are not allowed to set traps on your land for trespassers full stop.

If you are getting grief then report it to the police. What you are trying to do is very serious and incredibly dangerous.

You CANNOT absolve yourself from liability for personal injury.

As suggested get a light that turns on when they're there and maybe a webcam with some motion sensing software to record them.

Or build an IR block of leds to make a night vision cam?

Watch from the window & wait until they are on the fence & then flying kick it, makesure you film it so you can stick it on you tube :thumbsup:

maybe put up a motion detector 500W lamp. They are only about £10

Not the chickens as the neighbours are at the other end of the street on the other side of the road, they have always been funny since we lived two doors from her gobby sister before at our old house. The egg throwing started since her OH said something snide and I told him its a shame him and his wife wasnt with her sister (6 foot under).

I would be very wary of fitting razor wire, at least ask your local police first as apparently you have a duty of care even for burglars
