okay so i ordered windows 7 back in august from tesco direct for £49.95 (i think?)
but i changed my mind last week, phoned up and cancelled
money went back into my account within 2 days

so today i went to my dad's and there was windows 7 addressed to me, invoiced from tesco

what shall i do with it?

how can you say its theft when op cancelled - he told them he didnt want it - they have forced this on him/her - so cruel tescos - :-D

i'd sue them for causing you such grief - you had to answer your door unnecessarily:-D

Inform them that they have 6 months to collect it (at their expense) & if they don't then it's yours to keep.

Not theft but classed as unsolicited goods. You do not need to notify them but if they do not contact you within 6 months to collect, it's legally yours. You have to 'reasonably' look after the goods but have the right to charge 'reasonable' storage fee's.

its not unsolicited goods as he did order it, human/system error is allowed in law.
there is no specific time limit set on errors just genuine unsolicted goods, first he must inform tesco of receipt of goods then if they fail to collect within a "reasonable" time he may dispose of them.
also he cannot charge for storage without notifying them of receipt of goods and giving time to collect before charges are imposed.

hmm... i'm moving next week so i'll keep it in the packaging, and if they contact me about it, they shall recieve it back. if not, well... they'll probably get it back anyway!
