windows 7 for students

Hi all, my son is building a computer for his 18th birthday.
he will use it for Gaming and his school work.
he has a pc which is not up to the mark at the moment running windows xp. can he get the student upgrade from microsoft and put it on his new unit without a existing copy of xp on it?
