Windows 7 upgrade from play.com

So I bought a laptop the other day from play and on the product page was a link saying
Eligigble Windows 7 upgrade

So i got the laptop on Friday and have been setting it up to my liking and went through the link from play to register my laptop for the upgrade however my model is NOT eligible after all!!!

So what am I to do? Play stated it was, and I bought it assuming I could get the upgrade but it isn't.

I emailed play about them stating the eligible thing and as such they have now taken the link off the page but still I feel conned.

Ok, quicker than expected,
Got through to some autobot machine then an indian woman lol.

They ain't gonna do diddly squat!! and now I have to go through the manufacturer according to her as play ain't responsible......WTF

I finally stated "but YOU'RE selling the laptop on YOU'RE website and YOU'RE stating it's eligible, when it isn't".

But she was avin none of it, those indian people really get on my nerves.

So yeah, no luck.:x
Now will e-mail Acer to see what they have to say and why this model ain't eligible

The trouble with Play.com is that it is based outside the UK, so the Sale of Goods Act does not apply. You basically have to mug up on Jersey trading laws to find out what leg you have to stand on.

As far as I understand, the legal situation is that Jersey is not part of the UK and not part of the EU, except for trade in goods, which means you might be able to return the whole thing under the Distance Selling Regulations. This might be at your own expense with regard to shipping costs, however.

Returns for non-faulty items have to be made within 7 days (as per EU regs) but unless the item is unopened you would have to demonstrate that the notebook was sent to you "in error" according to Play's terms and conditions, which is vague to say the least. It might cover incomplete items, so I would persevere here with Play, first. Ask to speak to a supervisor.

I think I will keep the laptop now, it's took the best part of 2 days to rid all the garbage and install my stuff, not to mention the mess I had trying to get "Gears" running.

I bought the Laptop on Wed's 16th and got delivered on Fri so dunno what date that would pit me against for the 7 day thing.
Will have another phone tommorrow anyhow, and I'll keep your info handy, Thanks.

If push comes to shove, I may have to suffer Vista for now and hope something happens with regards to windows 7 in the near future. But i'm still annoyed at it to say the least.

I would keep pushing them at least for a parttial refund, If you get no joy try contacting Acer and tell them that play.com are falsley advertising their products,

If you get nowhere with either Acer or Play and still aren't fed up of the whole thing, it may be worth having a word with Microsoft, as its name is being used as an inducement to purchase. You could argue that either Acer or Play is deliberately misleading the buying public and dragging Microsoft's name into the mire. Microsoft may feel inclined to have words with Acer about its OEM contract. Not promising, mind, but if you don't ask, you don't get.

Regardless of the make of laptop, if you have Vista Premium then according to MS you are entitled to the upgrade.

As spraint said, if you get no joy form Acer take it to MS.
