Hi,
I've got a windows upgrade disc and COA that was supplied with a Dell laptop. It is to upgrade windows xp pro to Vista Business. I have never bothered to upgrade and am happy with XP Pro.

I have listed it on ebay but they've removed it saying it has been highlighted to them by Microsoft as being against their policy and I cant sell it on ebay.
Its genuine, sealed, and provided to me. It is definetely not fake.
I've tried changing the listing and they've removed it again.

Does anyone know how I can list this without it being removed again. As I would really like to sell.

It is really annoying as I actually paid dell extra for this upgrade.

Am I allowed to sell this on here ? any one know how much it might be worth ?

Sounds like you were reported by a competitior, sell it on Amazon, tonnes better than ebay.

Don't think so - it's a disc to upgrade the OEM version of XP which is tied to the Dell machine.

Think you have to sell it with a piece of hardware!
Think its probably worth @£70. depends who you are selling to. there are loads of deals out there for students & charities etc.

They have not, they have had the listing pulled because microsoft are VERO registered they have been reported under this. If your listing gets pulled as a company who is registered under the VERO scheme asked for it to be, never relist until you have sought permission from the rights holder. Do not relist otherwise ebay will ban you account and you will be in hot water with the VERO holder.


And a good reason to not sell it on ebay but on Amazon

Not really no as if op has infringed intellectual property rights, he will do so by listing it on Amazon as well. Repeat offenders don't just get a slap on the wrist from ebay you know. It's a representative of Microsoft that has asked for the listing to be pulled twice now. If the company wanted to take action they could, umbro are ones that are nice for that for example...... Representatives do look at amazon and play trade and the like you know.............


I think the op is interested in alternative places to sell not his alledged infringement.

The point is Microsoft have reported the re-selling of this software as infringing intellectual property rights. This is why the listing has been pulled. If he sells it anywhere else he will be doing the same thing. He does not have permission from microsoft to re-sell the software. As he has already been brought to their attention twice by trying to sell on ebay, selling online again would be foolish!


Then maybe he will shift it on here, it's had enough exposure now.

I find that highly unlikely, it's much more likely to be some troublemaking goit reporting the listings. If it is down to MS, explain this :

Thanks for the responses.
The item is a Dell branded upgrade disc with COA on reverse. sealed.
I listed with just a picture of the packaged disc, and didnt use any of the MS images.
What's really irritating, is that although the upgrade was free I had to pay a handling charge (something like$25) so in effect I purchased this and now I dont want it I cant sell.

Do you think it would be possible to post it on here for sale or am I likely to have problems here too ?

You are not allowed to sell OEM software on eBay. That is why it was pulled.

From ebay...

"OEM" or "bundled" copies of software may not be listed on eBay unless it is being sold with computer hardware.


Hence the reason big companies like Ebuyer used to sell windows in a package with a mouse/soundcard etc. The hardware is useless without an os therefore...... ;-)
