I was wondering, has anyone had a work injury big or small before?

Ive just had a injury due to company not supplying any safety equipment or giving enough man power to do the job. My injury is not bad but its left me off work for a week or so and doc says it takes 6 weeks to fully recover.

Whats the process? where does compensation money if any come from? Would the company see you differently or find excuse to dismiss you if you claimed comp due to work injury? What should i look out for or worry about? Or do you recommend no to claim comp? advice appriciated.

firstly they should pay you in full for the entire time you are off work as its their fault

what happend? if its there fault they should pay u for the week plus the other 6 weeks, if u dont plan to goto work becuase of the injury

Had my ear ripped off at the top by a dog at work had it glued back on, had a massive puncture wound also from a dog to my left hand 5-6yrs ago and still there is a scar. This dog had been given to me by the Army with a well documented bad back, all the bites were as a result of the bad back. Forgot to claim though as when the dog was put down eventually from the bad back I was too upset. Don't know what I would have claimed for though as I didn't take any time off work other than driving to the cottage hospital and spending 6hrs of work time there?

Are you employed full time?

Do you have a copy of your contract terms and conditions?

You should get sick pay in all probability for the time the doc has allowed you sickness. If you're still hurting come the end of the week, go back to the doc and say you need more time.

It's your employers' legal requirement to provide a safe working environment. They should have carried out risk assessments etc. on the job you were doing, and identified if there was any safety equipment required. If this equipment is required, and they failed to provide it, you may have a case for compensation, although if it's the type of injury where you are only off work for a week it's not likely to be worth your while.

Make sure you get paid (in full) for any time you have off, and make sure the injury is recorded (your employer should have a record book somewhere). Also, I think if an injury sustained at work results in more than 3 days off, it has to be reported to the Health & Safety Executive.

My Mum used to work in a potato factory, she slipped on a potato that was on the floor, which shouldn't have been there as they had workers who were supposed to clean up everything that was dropped, anyways she tore all the ligaments in her foot and was off work for weeks with it, she put in a claim and won £10,000, it took her forever to get it tho, the company terminated her contract for whatever reason I cant remember.

Anyways I'm not saying go and sue them as it would probably result in you losing your job, just telling you the experience she had.

It is great that people want to help but sometimes their help hinders. People of the forum doesnt recognise that the law isnt as clearcut as they think it is!!

Exactly.

For instance, firms of solicitors who are negligent in their advice etc. Medical negligence etc. Every year their premium goes up as well.

If an employer asks someone to do a job and doesn't supply the necessary equipment, and an accident then occurs resulting in injury, the company is liable. Pretty clearcut to me.....

The OP doesnt say anything about whether he is actually employed or self employed or whether he is under a contract for service or a contract for services.

Was the accident in the ordinary course of the business? Was it through the negligence of another employee or is the employee himself resposnsible (vicarious liability is evident however). Was the accident foreseeable or reasosnably foreseeable?

There is so many more other aspects of law that I could introduce but I wont as the above will suffice.

my company were carp, would try to wriggle out of everything didnt even do a risk assesment when i was pregnant, what im trying to say if your company are tits like mine they might cover it up so to speak

I had a waitress sue a hotel chain i worked for, she slipped on a wet floor, the floor signs were out and she was the one who had just washed the floor! she sues won over £15K then lost her job, and the cheeky so and so even reapplied for her job 2 years later thinking that most of us managers had left..lol she didnt get the job.
just thought id mention this as if you sue your company you may lose your job in the process although im not sure its legal to do that now.? someone on here will put me right


its illegal to sack someone for sueing them but like most posters have said if they then want rid of you after that (and most prob would) its quite easy for them to do
