I know I've done nothing but ask questions about Xbox 360s but I have one more.

I got one from Play.com and the box (360 box, not the outer packaging) was a bit bashed about but everything was packed up neatly inside and I opened it all and tested it and it worked fine. I called Play and they said that it was definitely new, not returned or refurbed. Only thing is, on top of everything else, I'm almost certain its not a Falcon. So the Question is, how likely is it to **** its-self being the older chipset and maybe kicked about a bit. Its only 2 weeks to Chrimble now and its a pressie for my son and I wouldn't like to see him disappointed..

mines not a falcon, and it's still going (touch wood)
But if your worried just tell them the product is damaged and you don't want it, I imagine solving the problem early on would allow you to enjoy the run up to christmas rather than worrying about whether or not your son's xbox is going to work.

Should mention, I did open it to test it to see if it was a Falcon. Not sure if they would still take it back since I've broken the packaging.

Even if you did get a replacement from Play - there is no gaurantee it'll be a Falcon.

MS have extended the warranty for "three red lights" to 3 years so you'll be okay on that respect if it does go wrong and as the falcons are only just appearing how do you know they will be more reliable?

I would however be tempted to give Play another call mainly from the point of view that its going to be a gift and I'm sure the recipient would prefer one in a pristine box. You never know they might give a discount or a freebie if you keep that one (however I've seen reports that Play customer service can be unhelpful).

Its a new chipset which is supposed to run cooler and use less power (175w) otherwise the rest of the xbox is the same. Many have speculated that as it runs cooler there will be less faults.
