Zoombits Chat Transcript
Hi,
I'm new to the forum although I've used Hotukdeals for a long time.
I ordered some RAM from Zoombits a few days ago and the order has stated 'Ready to print' for a while so I spoke to 'Matthew' on the live chat facility who told me it is currently out of stock. I asked for the order to be cancelled and he told me that apparently I am not entitled to cancel as it is RAM and therefore non refundable/returnable. I knew this when I ordered and if I cannot get a refund then that's fine I'll wait for the item to come in stock, my concern is that the item will never come into stock and I will be £68 out of pocket with nothing to show for it. I stated this in the live chat and, unless I misinterpreted what he said, even if it does not come into stock then they will not return my money.
Rather than get irate with the live chat operator I decided I would post the transcript on here to see whether they are in the wrong:
info: Welcome to Live Chat. One of our operators will be with you shortly.
info: All operators are currently assisting others. Thanks for your patience. An operator will be with you shortly.
info: You are now chatting with 'matthew'
matthew: Welcome to Live Chat. How can we help?
you: Hi, I ordered something from you two days ago and it says on the order status 'Ready to Print,' what does that mean?
matthew: order number please
you: xxxxxxxx
matthew: I'm sorry for the delay. I'll be right with you.
you: ok
matthew: your item you have ordered is currently out of stock
you: ok, do you know how long stock will take to be in?
matthew: I will be right with you.
matthew: i dont have time sclae at moment but hopefully should not be to long
you: ok, sadly I think I'll need to cancel the order as I need it by next week at the latest
matthew: as you ordered RAM item is non exchangeable or refundable as per terms and conditions on our website
you: right so if the item does not come in stock will you then refund me?
matthew: no coz RAM is none refundable only if RAM is faulty then we refund
you: so if it does not become available and I am waiting indefinitely then I will not receive a refund?
matthew: yes that is correct
you: ok, thanks for that
matthew: You're very welcome and have a nice day...
Am I mad or does that seem a bit dodgy?

Kelsey: if you don't receive your order then yes you can be refunded, however if you receive it, realise its not what you wanted we cannot refund then
you: Does that comply with Distance Selling Regulations?
Kelsey: please see our Terms and Conditions if you are not happy with my answer. When it comes to RAM we do not refund unless its because you have not received the order
you: Does that comply with Distance Selling regulations
you: Terms and Conditions do not overrule law
you: Can you confirm?
Kelsey: All I can say is as I have been - when it comes to RAM we do not advise we do not refund and it is non returnable, ....
you: I'll pass then
you: Good day.

According to their own terms and conditions you do not have a contract with them. If they have already taken payment, call them, tell them you are cancelling the order as per their terms and conditions and contact card company to stop the payment (chargeback if necessary).
Thanks for all the responses, its very reassuring knowing other people found them to be completely useless too!
I gave them a ring and the order has now changed to 'being refunded' so I'll keep an eye and see if it actually happens!
I'm re-ordering my RAM from Crucial, its £20 more but seeing as the RAM at Zoombits is non-existent then Crucial is actually the cheapest for what I need!
Thanks again, this has been the most useful post I've made on a forum!
.
Yes they can, but the Jersey version as i linked to above
Glad its sorted OP
I offered to do it for them when I go to trading standards. They didn't accept my offer.

The Jersey version is no good to anyone not in Jersey though is it?
You can't take them to court in this country.
*waits for deanos to pretend he didn't come back to the thread*

When you buy outside the UK they you need to use the law of said country.
If you bought something from say the USA would you quote the SOGA to them ?
No you would quote whatever law is relevant in the USA as they is what applies to buyer and seller

Can you link me to this information?
After you link me this information, would you be able to take the US seller to court if they failed to comply?
If so, what court in which country?
I'm shocked.
Lulz. So a UK buyer can effectively take no action against the US seller, or Zoombits?
You'd think.
