Parking ticket issued over 3 months after event.

I'm sure someone here will know the answer to this, I have been trying to look elsewhere but still haven't found an answer. ParkingEye has issued me with a fine for staying 8 minutes over the allowed 2 hours in a Aldi carpark. This was on The 2nd of July, the 14th of this month they have issued a fine. Are they allowed to wait this long after the event? Cheers.

However some advise to appeal or pay up because the odd case has been taken to a small claims court. Probably a 1 in a million chance.

    Numpties on here still think the old law applies , hence the misinformed comments . If they can prove it (presumably by CCTV) you are a dead duck . Check it out yourself , but believe some of the Numpties on here at your peril . Remember its your money - not theirs !

    I’ve had 2 of these in the last 2 years First in McDonald’s Second in a loc …I’ve had 2 of these in the last 2 years First in McDonald’s Second in a local shopping centre What ever you do don’t contact them , once you do they will hound you , I got about 5 letters saying I’m going to court then the balifs are coming round bla bla . Once they k ow you ain’t going to reply they move on to the next victim . Do you really think they have time and money to take 1000s of people to court ?They work on a quick payment if they can’t get the money quick they leave it ,this is why they send letters trying to scare you Don’t make contact Don’t open letter They will go away



    You are wrong here and it’s bad advice to be giving. Just because you ignored it and it went away doesn’t mean it will in this case. Also who is to say you don’t get a CCJ in the near future?

    also aldi did get money from parking eye but it’s not their main source of income, we are and if you don’t speak up to them on the matter this sort of thing is going to get more and more common. Somerfield cancelled their contract with parking eye after complaints

    Only court issued bailiffs have any authority, the guys the parking companies threaten you with are part of the same company and don't have the same power ;). (edited)

    If we put this post in context, it should read:
    A few months ago I decided to go shopping, and, as I was too tight to pay for parking. I thought, where can I park for free, and decided I could abuse Aldi’s free parking for their customers. I didn’t have any thought about stopping Aldi’s actual customers from parking, as I am quite selfish. Unfortunately I over-abused the free parking and got caught. Can anyone help me get out of this correctly issued parking fine.

    This was correct pre 2012 because the company could only get the registered keepers identity and this could be different to the driver. The Protection of Freedoms Act brought in keepers liability so the keeper can not be liable for the ticket and the parking company can take you to court and get an enforceable fine.

    please stop sprouting this rubbish because you don’t know anything about this process

    Just ignore it, 3 months the after the event they are probably hoping you just pay up. Or go to Aldi and tell them as it was 3 months ago you can not find the recipe but was instore and if they had more tills open you would have not gone over the 2 hours.

    dodgy scammers these cowboys hope to intimidate ppl into paying there invoices making it look as near as possible to an actual parking ticket as its only 8 minutes you overstayed i would personally bin it
    imagine all the publicity aldi would get from using a company that takes ppl to court for overstaying 8 minutes

    It’s harder to just ignore now and that’s no longer the guideline for these cases nor is the pre estimate of loss method. About 5-6 years ago they started taking cases to county courts and this can land you in a real mess with CCJ’s and parkingeye seem the most aggressive in this aspect. Before contacting parking eye start with the land owner it’s very likely they will cancel the ticket anyway.

    If you can't easily find the answer, then I suggest you register and post the question because it may just be me but I find that site is tricky to trawl.

    Does the PCN mention PoFA (Protection of Freedoms Act 2012)? If so, ANPR tickets should be issued no later than 14 days after the alleged infringement.

    Only an extremely small amount of cases have been taken to small claims. It's a gamble now whereas before it was a given. I would gamble but you do risk extra charges admittedly.

    I'm in the same position with a company called parkwatch, I have emailed them to tell them I dispute it and will await a reply.

    I dont see why a fine has to have any time limit on it. Financial claim have up to 6 years in a courtof law.

    I think I would send them a nice little letter apologising for your forgetfulness & a cheque for £10 to compensate them for their "losses". Stating also the car park was pretty much empty & you never saw the sign but you did indeed use the shop.

    After all they had to write to you & spend a bit on admin & printing.

    If they rejected your £10 then I doubt any judge would look kindly on the abuse of court time should they issue proceedings. (edited)

    Having recently got a ticket from parking eye myself I can vouch for the fact that is difficult to get a fast resolution. You have to deal with them by letter, no calls, no emails. They DO take people to court, and they win as the law was changed about 4 years ago to give the necessary powers. In my case PE had taken over parking at our doctor's surgery and I honestly forgot to input my reg number. I was able to call the surgery and get proof of my visit and the company rescinded the ticket.
    A friend however thought he could ignore a ticket issued as he waited in a private company's car park near MCR airport, he was trying to avoid paying to park while waiting for a flight arrival. He kept ignoring letter after letter and only paid after receiving a county court judgment against him. He'd even ignored the letter giving him the court hearing date and time. Total cost £253. My advice, definitely do not ignore it, you could claim after so long that you'd lost any receipt you'd had from Aldi but 2hrs 8 mins is a really long time to spend in a store that usually has only 4 or aisles!

    P.S It does state on the initial letter that they will only deal with Pepipoo after Parking Eyes own appeal procedure has been tried. (edited)

    i would never advise anyone to ignore demand for money. i have seen those cant pay we take it away program and people who ignore demands end up in court, paying thousands in bailiff fees and court fees. an original debt of £700 ending up £3,000 because they ignored it. if they had a brain and paid the £700 in the first place, they could have saved everyone's time, including themselves, and their own money to the tune of £2,300! idiots.

    I watched the same show you watched. The daughter kept using a particular car park and ignored the parking charge notice (or whatever the technical name is) after it went to High Court it ended up being £3k instead of £700. The parents were really miffed at her stupidity.

    As for this actual instance. It was 8mins longer than the 2hrs maximum which IMHO would be the only thing to question/challenge.

    Yes contact the store manager and politely ask if they can sort but get it in writing. If the store cannot/will not help then offer a small fee to cover the additional time (again offer it in writing)

    AFAIK although the laws/rules have changed these private companies still have to issue reasonable charges to cover their losses and that's the point I'd challenge if I thought the fine was excessive.

    there were so many incidents on the show where the original claim, not just parking, but all sorts of claims, starts off a few hundred quid but by the time they make it to the show it had increased 5 to 6 times the original claim, just crazy. and all because the defendant just buried their head in the sand, hoping it will go away. they try all sorts, like hiding at a different address down the road, hoping the bailiffs won't find them. lol.
