TERMS AND CONDITIONS

1. Participating in this promotion implies full acceptance of these Terms & Conditions as a whole.

2. This promotion is only open to legal residents of the United Kingdom aged 18 or over.

3. This Promotion excludes employees and their immediate families of Kellogg’s, its agencies, or anyone professionally connected with the Promotion.

4. Purchase of a Pringles can and internet access are required. This is an online promotion only, there is no postal or telephone application route. No purchase necessary for Northern Ireland. See clause 8 for details.

5. Main Promotional Period: The Promotion is open from 00:01 on 11 April 2022 until 23:59 on 1 September 2022. Entries can be made between 00:01 and 23:59 each day during the Main Promotional Period.

6. Catch All Draw Promotional Period: Entries made between 00:01 on 2 September 2022 and 23:59 1 October 2022 will be entered into a Catch All Draw.

7. To enter the Promotion, entrants must:

a. Purchase a can of Pringles;

b. Visit Pringles.com and register for a Kellogg’s account if they have not already done so and complete the multi-factor authentication requirements if required, or log in using a social media account;

c. Enter the 19-digit batch-code found on the bottom of the Pringles can;

d. Winning entrants will be notified immediately on screen;

e. Entrants will then be given the opportunity to claim a 1-month Xbox Game Pass Ultimate (max 1 per person, New Xbox Game Pass Ultimate members only).

8. No purchase necessary for residents of Northern Ireland. For a free entry, follow the steps below:
a. Visit Pringles.com and click on the ‘Contact Us’ link;

b. Scroll down to the ‘Contact Us by Email’ section;

c. Select ‘Promotions’ in the ‘Select Topic’ drop-down box and then click ‘Continue’;

d. Select the promotion name ‘Pringles 2022 Gaming Promotion’ from the drop-down menu;

e. Select ‘Promotion Issues’ in the drop-down menu below;

f. Fill out the message box, ensuring that “Xbox Game Pass Ultimate No Purchase Necessary” is included at the top of the message;

g. Fill out the request form including the entrant’s full name, postal address (including country of residence), phone number and email address;

h. Click ‘Submit’;

i. Entrants will receive an email from Pringles Customer Services with a batch code that they can use to enter on the promotional website after registering for a Kellogg’s account.

9. Each batch code qualifies for one entry into the Promotion. Each entry must be accompanied by a new batch code and receipt of a purchase made within the Main Promotional Period and Catch All Draw Period that pre-dates the time and date of entry (excluding any winners that entered through the no purchase necessary route outlined in clause 8).

10. Winners must retain the itemised receipt that states the time and date of purchase prior to entry (excluding any winners that entered through the no purchase necessary route outlined in clause 8), and the can with the winning batch code as they may be required at any time for validation and in order for the winner to receive the prize.

11. Entrants may submit 1 entry per day during the Promotional Period. Once an entrant has entered the Promotion a total of 50 times throughout the entire Promotion Period, they will instantly be notified on screen that they need to provide Pringles Customer Care with proof of purchase (excluding any entries made through the no purchase necessary route) or batch code for all entries submitted. If proof of purchase or batch code for all entries submitted cannot be provided, that entrant will no longer be eligible to enter the Promotion and all subsequent entries will be void.

12. Max. 1 prize of each prize type per person during the entire Promotional Period.

13. Main Promotional Period Winning Moments: During the Main Promotional Period, 105 ‘winning moments’ (days, hours, minutes, seconds), have been randomly selected by an independent verification service. The first entry of a valid batch code on or after that winning moment will be awarded the prize. If no entry is received between one winning moment to the next, the prize from that winning moment will be rolled over, creating an additional winning moment. All 105 prizes are available to be won.

14. Catch All Draw Promotional Period Winner Selection: 1 winner will be randomly selected from all valid entries received during the Catch All Draw Promotional Period. For your total confidence, the Prize draw will be conducted by PromoVeritas, the independent Promotional verification service, within 5 working days of the end of the Catch All Draw Promotional Period.

16. Catch All Draw Promotional Period Prize: 1 x Xbox Series S.

17. Main Promotion Winner Notification: Winning entrants will be notified immediately on screen that they have won and will be sent a confirmation email to the email address registered to their Kellogg’s account.

18. Catch All Draw Winner Notification: The winner will be notified via email to the email address registered to their Kellogg’s account within 28 days of the Catch All Draw. The prize will then be sent to the postal address registered to a winner’s Kellogg’s account.

19. Prizes will be sent to the postal address registered to the winner’s Kellogg’s account. Winners must please allow up to 90 days for delivery of the prize, although we will endeavour to send these out within 28 days of winning.

20. In the unlikely event that a prize doesn’t arrive within 90 days of winner communication, winners will have a further 28 days to inform the Promoter by visiting the Contact Us page on Pringles.com. In the event that a winner does not inform the Promoter within this time frame, the Promoter will reserve the right to not reissue the prize or limit its value at their sole discretion.

21. If a winner is disqualified for any breach of these terms and conditions, or in the event any Prizes from the Main or Catch All Draw Promotional Periods are rejected, undelivered, unclaimed or returned to sender, the Prizes will be deemed as unwanted. In this instance, the Promoter reserves the right to return a Prize into the Promotion prize pool if it is forfeited during the Main Promotional Period.

22. Following the end of the Catch All Draw Promotional Period, in the event of any prizes from the Main and Catch All Draw Promotional Periods that are rejected, undelivered, unclaimed, or returned to sender and were not re-entered Into the Promotion Prize pool, the Promoter reserves the right to request that an independent person conducts a random draw for all non-winning entrants. As this depends wholly on what is won during the Promotion, the number of prizes that may be awarded by this route is unknown. Any winners via this route will be notified via email within 28 working days from the end of the Promotional Period.

23. During the Main Promotional Period, entrants can also redeem a maximum of one (1) Free 1-month Xbox Game Pass Ultimate gift, available to new Xbox Game Pass Ultimate members only.

24. 1-month Xbox Game Pass Ultimate Gift Details:

Redeeming automatically upgrades existing membership(s) to Xbox Game Pass Ultimate at a conversion ratio each based on days remaining. Once upgraded, you cannot convert back to previous membership.

27. Winners will be responsible for any applicable taxes related to the acceptance of any Prize.

28. It is the responsibility of the winner to supply the correct personal information to claim the prize. The Promoter will not be liable for the non-delivery of the prize caused by the provision of wrong information.

29. Winners may be required to take part in publicity with no recompense. Participation is optional and is not conditional to accepting a prize.

30. No responsibility can be taken for entries or claims which are misdirected, lost, delayed, damaged or corrupted during delivery to or from the Promoter due to any computer malfunction, virus, bug, delay or other reason whatsoever. The Promoter is not responsible for any incorrect or inaccurate information supplied to the Promoter by the claimant in the application.

31. To the fullest extent permissible by law, the Promoter, nor their respective parent, affiliated companies or subsidiaries, together with any associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using a Prize, except for any liability which cannot be excluded by law. Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.

32. There are no other prize alternatives available in whole or in part. For a non-cash prize, no cash alternative is available unless otherwise agreed with the Promoter. If the stated prizes are no longer available due to circumstances outside of the Promoter’s control, the Promoter reserves the right to substitute it for an alternative prize of equal or greater value. Unless otherwise agreed in writing by the Promoter, the prizes will only be awarded directly to the winners.

33. Insofar as is permitted by law, the Promoter’s decision is final with regards to all Promotional matters and no correspondence will be entered into. The governing courts will have final say in the event of any legal dispute. By participating in the offer, you accept these Terms & Conditions and are bound by all the rules in full.

34. The Promoter reserves the right at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these conditions or the spirit of the Promotion.

35. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of prizes, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these Terms and Conditions, at any stage, but will always endeavour to minimise the effect to entrants in order to avoid undue disappointment.

36. The Promoter will not be liable for any failure to comply with its obligations or any delay in performing its obligations within these terms and conditions if an act, omission, event or circumstance occurs caused by (but not limited to) global or regional health crisis, epidemic, pandemic, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostility, political unrest, riot, civil commotion, famine, plague or other natural calamity and act of God or any other circumstances beyond the reasonable control of the Promoter.

37. The Promoter reserves the right to verify all entries and winners and to refuse to award a prize or seek recovery of its value if the prize has been awarded, or withdraw a prize entitlement or refuse further participation in the Promotion in the event of any entrant’s fraud, dishonesty, where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this Promotion’s entry requirements or otherwise where an entrant has gained unfair advantage in participating in the Promotion or won using fraudulent means.

38. An entry must be made directly by the individual entering the Promotion. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or other automated means together with entries which do not satisfy the requirements of these Terms & Conditions in full shall be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘bots’, disposable email addresses, ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant’s entries into the Promotion in a way that is not consistent with the rules of the Promotion, that entrant’s entries shall be disqualified and any prize awarded shall be void.

42. In the event of a discrepancy between these Terms & Conditions and the details in any Promotional material, the details in the Terms & Conditions will prevail.

43. These Terms and Conditions shall be governed by English Law and any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales unless the consumer is a resident in another part of the United Kingdom, in which case the laws and jurisdictions shall apply.
