Or they have that GAME purple seal-sticker on them and I always think, "This is opened by GAME staff. Nintendo's shrinkwrap has been opened. By definition, this is no longer new."

Maybe by legal definition it's still new, but by eBay's definition, it isn't. I like how The Game Collection will say New & Opened if that's the case. Personally I find Zavvi and Amazon -- retailers with no physical shop-front -- to have the least opened stock.

like my Game & Wario recently. their response was that it was "old shop stock" that had been returned to the head office and should never have been sold as "new". they never did reply when I asked why this stock was on their warehouse in the first place if that was the case. scam artists.

Personally never had an issue with GAME online.

Last few new items I have orders have all been sealed. From my experience it's the pre owned consoles that you need to be weary of. Plus the pre owned collectors editions that rarely turn up with the collectors items unless you are very lucky.. I don't mind though as I just take them back to the store for a refund if in not happy. Just don't open the game seal.

Not just me this has happened to then.... I got "New" Tank Tank Tank for WiiU after it was HOT a while back, and it turned up with a scratch/cut on the game box and no official "Nintendo Seal" wrap. Then I noticed the invoice even said "Mint" but my order said "New". Needless to say went back for a full refund...
