Hopefully you'll get a proper sealed one with ms certificate of authenticity sticker and not game/gameplay/gamestation 28 day returns policy purple sticker which indicates your disc will be scratched, marked, grimy, something they had on display, found on the floor, used as a frisbee when they got bored but generally did not look after and is not New as advertised.

I have Watchmen and Wet sitting here to go back from an order of [email protected] Gameplay only 1 had m$ sticker/seal and was in New condition (I think you will be OK with Darksiders) If you were to get one you are not happy with simply return but when it's title after title it gets very frustrating

Happened to me with prince of persia from game for £4.98, i ordered it NEW on their website, and they sent me a used one, scartched n marked to hell box, with the purple sticker on it.
You can return them to game instore, providing you take the invoice that came with it, and the card you used to pay for it.
Told the girl i wanted a new SEALED copy like i had paid for, as this one was pre-owned, she said " how do you know it's pre-owned if you havent broke the purple seal"! ( i kid you not)!
I said well for a start it's not factory sealed with the official microsoft seal, that normally tells you it's a new game.
So SHE opened it, and said the disc & instructions are new look, but the disc had a mark on it.
I asked her if i could get a sealed new copy, but they didnt have any, so she gave me a better condition box, and put the purple sticker back on.
Now i know it was only £4.98, but it's the principal of the matter, the pre-owned copy was £3.98 and was NOT what i paid for.
How many unsuspecting parents or people in general just assume the games new and carry on oblivious to the fact it's been played before!
I contacted their customer service email, as of which i still have not got a reply over 2 weeks now!
It does seem to be totally pot luck, but it's a HUGE scam game,gamestation and gameplay ALL do!
Be warned.

This is a hassle people should NOT have to do after buying something advertised as new, and getting it used!

That logic makes no sense when the game does not work and breaks your ROM drive.

Mm, never had cases that extreme, I tend to purchase used games often admittingly I have never purchased a new game and got a used one in return, but the used ones are similar to the new ones with the exceptions that:
Someone else had pawed it before you did.
You don't get to break the seal
The disk may be scratched.

Breaking of the ROM drive? Aren't those the rare extreme cases?

Using a scratched, machine cleaned disc, Which actually takes a physical layer of the disc off..(I don't mean a dual layer disc will end up as 1:lol) fingerprints, foreign material . Will make the mechanics in a ROM drive have to work harder at doing it's job than necessary, eg re focus, servo motor reuse, re read data. A DVD ROM drivew will read data at the speed it can when capable. When it cannot read data so well because of the poor condition of the disc it will need to re-scan, re read re focus, SLOW DOWN , keep going over same point till it can get the data. More wear n tear than is needed and will result in the drive failing sooner than it should.

I thought that you have implied that the ROM breaks upon the insertion of the disk rather than a slow degradation of the capability. My disks are all slightly scratched and there are virtually no problems with the machine as it stand, except for a few dusty episodes. If disk is cleaned properly upon insertion there are virtually no problems unless it has been violently scratched(Which occurs when the console changes the positioning rapidly). Although the point is valid the process which you have described would take a LONG period of time to affect the console in a drastic way.

You have the means now to find out if the disc will DDE at any point on the range of sectors used by installing to Hard drive if it fails your disc is broken. Clean, repeat attempt to isntall to HDD, still the same and fails the disc is broken.

Its their stock answer, I have had this 2 or 3 times over the phone with gamestation. It as mentioned by donta is just Russian Roulette if you get a 'proper' sealed copy. I tried getting the Special Edition Assasin's Creed II, 3 times from gamestation 'new' and mine looked like it had been stamped on, on the floor yet the customer service staff were "I assure you it's new, it might just have been on the shelf in a store".

Its a pain with these game / gamestation deals. I gave up with ACII and got my money back but then the next week risked Need for Speed Shift from game and it was sealed properly.

I got this from Amazon for the same price and it was delivered in 2 days !
