Terms like this don't really hold up on the face of the actual laws (e.g. GDPR, PECR, DPA, etc).

Perhaps true, but the fact that developer even makes that statement, makes me wonder how much care has gone into securing/encrypting user data.
It's pretty much irrelevant what the law says once the personal data has breached and out there on the internet.
